13         Senate Amendment (with title amendment) 
14         On page 73, between lines 29 and 30,
15  
16  insert:  
17         Section 33.  Subsection (1) of section 408.036, Florida
18  Statutes, to read:
19         408.036  Projects subject to review; exemptions.--
20         (1)  APPLICABILITY.--Unless exempt under subsection
21  (3), all health-care-related projects, as described in
22  paragraphs (a)-(h), are subject to review and must file an
23  application for a certificate of need with the agency. The
24  agency is exclusively responsible for determining whether a
25  health-care-related project is subject to review under ss.
26  408.031-408.045.
27         (a)  The addition of beds by new construction or
28  alteration.
29         (b)  The new construction or establishment of
30  additional health care facilities, including a replacement
31  health care facility when the proposed project site is not

SENATE AMENDMENT Bill No. CS for CS for SB 400 Amendment No. ___ Barcode 702198 1 located on the same site as the existing health care facility. 2 (c) The conversion from one type of health care 3 facility to another. 4 (d) An increase in the total licensed bed capacity of 5 a health care facility. 6 (e) The establishment of a hospice or hospice 7 inpatient facility, except as provided in s. 408.043. 8 (f) The establishment of inpatient health services by 9 a health care facility, or a substantial change in such 10 services. 11 (g) An increase in the number of beds for acute care, 12 nursing home care beds, specialty burn units, neonatal 13 intensive care units, comprehensive rehabilitation, mental 14 health services, or hospital-based distinct part skilled 15 nursing units, or at a long-term care hospital. 16 (h) The establishment of tertiary health services. 17 18 Notwithstanding any other provision of law, the addition of 19 acute care beds at a hospital with existing acute care beds 20 licensed under chapter 395 is not subject to 21 certificate-of-need review. 22 23 (Redesignate subsequent sections.) 24 25 26 ================ T I T L E A M E N D M E N T =============== 27 And the title is amended as follows: 28 On page 3, line 31, after the semicolon, 29 30 insert: 31 amending s. 408.036, F.S.; providing that 2 2:00 PM 05/01/03 s0400c2c-37j04
