| 1 | A bill to be entitled | ||
| 2 | An act relating to obscenity; requiring public libraries | ||
| 3 | to install and maintain computer software or equivalent | ||
| 4 | technology that prohibits access to obscene materials by | ||
| 5 | minors; providing that the installation of software or | ||
| 6 | technology in a library having only one public-access | ||
| 7 | computer is within the library's discretion; providing a | ||
| 8 | finding of important state interest; providing an | ||
| 9 | effective date. | ||

| 11 | Be It Enacted by the Legislature of the State of Florida: | ||
| 12 | |||
| 13 | Section 1.Each county or municipal public library that | ||
| 14 | makes available for public use computer on-line service, | ||
| 15 | Internet service, or local bulletin board service shall install | ||
| 16 | and maintain computer software or equivalent technology on any | ||
| 17 | computer that is made available to persons under 18 years of age | ||
| 18 | which prohibits access to materials that contain obscene | ||
| 19 | descriptions, photographs, or depictions. If the library has | ||
| 20 | only one computer available for public use, the installation of | ||
| 21 | such software or technology shall be within the discretion of | ||
| 22 | the library. | ||
| 23 | Section 2.In accordance with section 18, Article VII of | ||
| 24 | the State Constitution, the Legislature finds that the | ||
| 25 | installation and maintenance by public libraries of computer | ||
| 26 | software or equivalent technology that prohibits access by | ||
| 27 | persons under 18 years of age to obscene materials fulfills an | ||
| 28 | important state interest. | ||
| 29 | Section 3. This act shall take effect October 1, 2003. | ||
