  1                 Senate Joint Resolution No. ____

  2         A joint resolution proposing an amendment to

  3         Section 5 of Article XI of the State

  4         Constitution to require the Legislature to

  5         provide for a statement to the public

  6         concerning the probable financial impact of an

  7         amendment proposed by initiative.

  9  Be It Resolved by the Legislature of the State of Florida:

10  

11         That the amendment of Section 5 of Article XI of the

12  State Constitution set forth below is agreed to and shall be

13  submitted to the electors of this state for approval or

14  rejection at the next general election or at an earlier

15  special election specifically authorized by law for that

16  purpose:

17                            ARTICLE XI

18                            AMENDMENTS

19         SECTION 5.  Amendment or revision election.--

20         (a)  A proposed amendment to or revision of this

21  constitution, or any part of it, shall be submitted to the

22  electors at the next general election held more than ninety

23  days after the joint resolution, initiative petition or report

24  of revision commission, constitutional convention or taxation

25  and budget reform commission proposing it is filed with the

26  custodian of state records, unless, pursuant to law enacted by

27  the affirmative vote of three-fourths of the membership of

28  each house of the legislature and limited to a single

29  amendment or revision, it is submitted at an earlier special

30  election held more than ninety days after such filing.

 1         (b)  The legislature shall provide by general law,

 2  prior to the holding of an election pursuant to this section,

 3  for the provision of a statement to the public regarding the

 4  probable financial impact of any proposed amendment proposed

 5  by initiative pursuant to section 3.

 6         (c)  Once in the tenth week, and once in the sixth week

 7  immediately preceding the week in which the election is held,

 8  the proposed amendment or revision, with notice of the date of

 9  election at which it will be submitted to the electors, shall

10  be published in one newspaper of general circulation in each

11  county in which a newspaper is published.

12         (d)  If the proposed amendment or revision is approved

13  by vote of the electors, it shall be effective as an amendment

14  to or revision of the constitution of the state on the first

15  Tuesday after the first Monday in January following the

16  election, or on such other date as may be specified in the

17  amendment or revision.

18         BE IT FURTHER RESOLVED that the following statement be

19  placed on the ballot:

20                     CONSTITUTIONAL AMENDMENT

21                      ARTICLE XI, SECTION 5

22         ECONOMIC IMPACT STATEMENTS FOR PROPOSED CONSTITUTIONAL

23  AMENDMENTS.--Proposing an amendment to the State Constitution

24  to provide for statements of probable financial impact of

25  constitutional amendments proposed by the Legislature or by a

26  Constitutional Revision Commission in the same manner as

27  required for amendments proposed by initiative.
