14          Amendment (with directory and title amendments)
15          Between lines 405 and 406, insert:
16          Section 7. Paragraph (c) of subsection (3) of section
17    627.6487, Florida Statutes, is amended, and paragraph (c) is
18    added to subsection (4) of said section, to read:
19          627.6487 Guaranteed availability of individual health
20    insurance coverage to eligible individuals.--
21          (3) For the purposes of this section, the term "eligible
22    individual" means an individual:
23          (b) Who is not eligible for coverage under:
24          1. A group health plan, as defined in s. 2791 of the
25    Public Health Service Act;
26          2. A conversion policy or contract issued by an authorized
27    insurer or health maintenance organization under s. 627.6675 or
28    s. 641.3921, respectively, offered to an individual who is no
29    longer eligible for coverage under either an insured or self-
30    insured group healthemployer plan or group health insurance
31    policy;
32          3. Part A or part B of Title XVIII of the Social Security
33    Act; or
34          4. A state plan under Title XIX of such act, or any
35    successor program, and does not have other health insurance
36    coverage;

38          (c) If the individual’s most recent period of creditable
39    coverage was earned in a state other than this state, an insurer
40    issuing a policy that complies with paragraph (a) may impose a
41    surcharge or charge a premium for such policy equal to that
42    permitted in the state in which such creditable coverage was
43    earned.
