| 1 | A bill to be entitled | ||
| 2 | An act relating to the Department of Juvenile Justice; | ||
| 3 | amending s. 985.407, F.S.; requiring the department to | ||
| 4 | adopt by rule procedures for changing policies that affect | ||
| 5 | certain contracted services and programs; requiring | ||
| 6 | procedures for notice, public comment, assessment of | ||
| 7 | fiscal impact, and response by the department; providing | ||
| 8 | an effective date. | ||

| 10 | Be It Enacted by the Legislature of the State of Florida: | ||
| 11 | |||
| 12 | Section 1. Present subsections (2), (3), and (4) of | ||
| 13 | section 985.407, Florida Statutes, are redesignated as | ||
| 14 | subsections (3), (4), and (5), respectively, and a new | ||
| 15 | subsection (2) is added to that section to read: | ||
| 16 | 985.407 Departmental contracting powers; personnel | ||
| 17 | standards and screening.-- | ||
| 18 | (2) The department shall adopt a rule pursuant to chapter | ||
| 19 | 120 establishing a procedure to provide notice of policy changes | ||
| 20 | that affect contracted delinquency services and programs. A | ||
| 21 | policy is defined as an operational requirement that applies to | ||
| 22 | only the specified contracted delinquency service or program. | ||
| 23 | The procedure shall include: | ||
| 24 | (a) Public notice of policy development. | ||
| 25 | (b) Opportunity for public comment on the proposed policy. | ||
| 26 | (c) Assessment for fiscal impact upon the department and | ||
| 27 | providers. | ||
| 28 | (d) The department's response to comments received. | ||
| 29 | Section 2. This act shall take effect July 1, 2003. | ||
