  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         State University System Law Enforcement Trust

  4         Fund within the Department of Education without

  5         modification; carrying forward current balances

  6         and continuing current sources and uses

  7         thereof; providing an effective date.

  8  

  9         WHEREAS, the Legislature wishes to extend the life of

10  the State University System Law Enforcement Trust Fund within

11  the Department of Education, which was declared to be exempt

12  from the automatic-termination provisions of the State

13  Constitution by section 2(2)(i) of chapter 99-243, Laws of

14  Florida, but which after legislative review has been found not

15  to be exempt from such provisions, and

16         WHEREAS, the Legislature has found that the trust fund

17  continues to meet an important public purpose, and

18         WHEREAS, the Legislature has found that existing public

19  policy concerning the trust fund sets adequate parameters for

20  its use and that the trust fund should be re-created, NOW,

21  THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24  

25         Section 1.  (1)  The State University System Law

26  Enforcement Trust Fund within the Department of Education,

27  FLAIR number 49-2-434, which was declared to be exempt from

28  the automatic-termination provisions of the State Constitution

29  by section 2(2)(i) of chapter 99-243, Laws of Florida, is not

30  exempt from such automatic termination and is re-created.

 1         (2)  All current balances of the trust fund are carried

 2  forward, and all current sources and uses of the trust fund

 3  are continued.

 4         Section 2.  This act shall take effect July 1, 2003.
