  1                      A bill to be entitled

  2         An act relating to trust funds; terminating

  3         specified trust funds within the Department of

  4         Education; providing for disposition of

  5         balances in and revenues of such trust funds;

  6         prescribing procedures for the termination of

  7         such trust funds; declaring the findings of the

  8         Legislature that specified trust funds within

  9         the Department of Education are exempt from the

10         termination requirements of s. 19(f), Art. III

11         of the State Constitution; renaming specified

12         trust funds within the Department of Education;

13         providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  (1)  The following trust funds within the

18  Department of Education, Division of Colleges and

19  Universities, are terminated:

20         (a)  The Facility Construction Administrative Trust

21  Fund, FLAIR number 49-2-222.

22         (b)  The University of South Florida Medical Center

23  Trust Fund, FLAIR number 49-2-406.

24         (2)  Unless otherwise provided, all current balances

25  remaining in, and all revenues of, the trust funds terminated

26  by this act shall be transferred to the General Revenue Fund.

27         (3)  For each trust fund terminated by this act, the

28  agency that administers the trust fund shall pay any

29  outstanding debts and obligations of the terminated fund as

30  soon as practicable, and the Chief Financial Officer shall

31  close out and remove the terminated fund from the various

 1  state accounting systems using generally accepted accounting

 2  principles concerning warrants outstanding, assets, and

 3  liabilities.

 4         Section 2.  The Legislature finds that the following

 5  trust funds are exempt from termination pursuant to Section

 6  19(f), Article III of the State Constitution:

 7         (1)  Within the Department of Education:

 8         (a)  The Lottery Capital Outlay and Debt Service Trust

 9  Fund, FLAIR number 48-2-004.

10         (b)  The Capital Improvement Fee Trust Fund, FLAIR

11  number 48-2-071.

12         (c)  The Construction Trust Fund, Florida School for

13  the Deaf and the Blind, FLAIR number 48-2-137.

14         (d)  The Educational Enhancement Trust Fund, FLAIR

15  number 48-2-178.

16         (e)  The State School Trust Fund, FLAIR number

17  48-2-543.

18         (f)  The Public Education Capital Outlay and Debt

19  Service Trust Fund, FLAIR number 48-2-555.

20         (g)  The School District and Community College District

21  Capital Outlay and Debt Service Trust Fund, FLAIR number

22  48-2-612.

23         (2)  Within the Department of Education, Division of

24  Colleges and Universities:

25         (a)  The Ancillary Facilities Construction Trust Fund,

26  FLAIR number 49-2-026.

27         (b)  The Division of Universities Building Fee Trust

28  Fund, FLAIR number 49-2-064.

29         (c)  The Capital Improvement Fee Trust Fund, FLAIR

21         Section 3.  The following trust funds are renamed:

22         (1)  Within the Department of Education, the

23  Construction Trust Fund, Florida School for the Deaf and

24  Blind, FLAIR number 48-2-137, is renamed the Construction

25  Trust Fund.

26         (2)  Within the Department of Education, Division of

27  Colleges and Universities:

28         (a)  The State University System Construction Trust

29  Fund, FLAIR number 49-2-137, is renamed the Construction Trust

 1         (b)  The Board of Regents Operations and Maintenance

 2  Trust Fund, FLAIR number 49-2-516, is renamed the Operations

 3  and Maintenance Trust Fund.

 4         Section 4.  This act shall take effect July 1, 2003.

 7                          SENATE SUMMARY

 8    Terminates specified trust funds within the Department of
      Education and provides for disposition of the revenues
 9    remaining in those trust funds. Specifies the trust funds
      within the Department of Education which are exempt from
10    termination under s. 19(f), Art. III of the State
      Constitution. Renames specified trust funds within the
11    Department of Education and the Division of Colleges and
      Universities. (See bill for details.)
