| 1 | A bill to be entitled | ||
| 2 | An act relating to direct payment for hospital or medical | ||
| 3 | services; amending s. 627.638, F.S.; providing for direct | ||
| 4 | payment of certain claims by an insurer to a provider | ||
| 5 | notwithstanding certain contract provisions; providing an | ||
| 6 | effective date. | ||

| 8 | Be It Enacted by the Legislature of the State of Florida: | ||
| 9 | |||
| 10 | Section 1. Subsection (2) of section 627.638, Florida | ||
| 11 | Statutes, is amended to read: | ||
| 12 | 627.638 Direct payment for hospital, medical services.-- | ||
| 13 | (2) Whenever, in any health insurance claim form, an | ||
| 14 | insured specifically authorizes payment of benefits directly to | ||
| 15 | any recognized hospital or physician, the insurer shall make | ||
| 16 | such payment to the designated provider of such services, unless | ||
| 17 | otherwise provided in the insurance contract. However, if: | ||
| 18 | (a) The benefit is determined to be covered | ||
| 19 | under the terms of the policy; | ||
| 20 | (b) The claim is limited to treatment of mental | ||
| 21 | health or substance abuse, including drug or alcohol abuse; | ||
| 22 | and | ||
| 23 | (c) The insured authorizes the insurer, in writing, as | ||
| 24 | part of the claim to make direct payment of benefits to a | ||
| 25 | recognized hospital, physician, or other licensed provider, | ||
| 26 | |||
| 27 | payments shall be made directly to the recognized hospital, | ||
| 28 | physician, or other licensed provider notwithstanding any | ||
| 29 | contrary provisions in the insurance contract. | ||
| 30 | Section 2. This act shall take effect upon becoming a law. | ||
