| 6 | a public-private partnership; providing for annual | ||
| 7 | carryforward of unused funds; providing for future review | ||
| 8 | and termination or re-creation of the trust fund; amending | ||
| 9 | s. 259.1051, F.S.; transferring certain funds from the | ||
| 10 | Florida Forever Trust Fund to the Florida National Scenic | ||
| 11 | Trail Trust Fund; providing an effective date. | ||

| 13 | Be It Enacted by the Legislature of the State of Florida: | ||
| 14 | |||
| 15 | Section 1. Section 260.22, Florida Statutes, is created | ||
| 16 | to read: | ||
| 17 | 260.22 Florida National Scenic Trail Trust Fund.-- | ||
| 18 | (1) There is created the Florida National Scenic Trail | ||
| 19 | Trust Fund within the Department of Environmental Protection. | ||
| 20 | The trust fund shall consist of funds transferred to the trust | ||
| 21 | fund as provided in s. 259.1051(4) and funds contributed from | ||
| 22 | any other source. | ||
| 23 | (2)(a) Funds shall be used to purchase sufficient legal | ||
| 24 | interest in the private property corridor needed to complete and | ||
| 25 | maintain the Florida National Scenic Trail. | ||
| 26 | (b) Funds from the initial transfer under s. 259.1051(4) | ||
| 27 | shall be used as a basis for the Florida Green Ribbon Campaign, | ||
| 28 | a public-private partnership between the department and | ||
| 29 | interested greenways, trails, and waterways organizations, the | ||
| 30 | purpose of which is to solicit sufficient moneys from federal | ||
| 31 | and local governments, corporations and other business entities, | ||
| 32 | private citizens, and any other source to complete the Florida | ||
| 33 | National Scenic Trail by 2010. | ||
| 34 | (3) Notwithstanding the provisions of s. 216.301 and | ||
| 35 | pursuant to s. 216.351, any balance in the trust fund at the end | ||
| 36 | of any fiscal year shall remain in the trust fund at the end of | ||
| 37 | the year and shall be available for carrying out the purposes of | ||
| 38 | the trust fund. | ||
| 39 | (4) Pursuant to the provisions of s. 19(f)(2), Art. III of | ||
| 40 | the State Constitution, the trust fund shall, unless terminated | ||
| 41 | sooner, be terminated on July 1, 2007. Prior to its scheduled | ||
| 42 | termination, the trust fund shall be reviewed as provided in s. | ||
| 43 | 215.3206. | ||
| 44 | Section 2. Subsection (4) is added to section 259.1051, | ||
| 45 | Florida Statutes, to read: | ||
| 46 | 259.1051 Florida Forever Trust Fund.-- | ||
| 47 | (4) For the 2003-2004 fiscal year only, and | ||
| 48 | notwithstanding any other provision of this section and s. | ||
| 49 | 259.105(3) to the contrary, the sum of $20 million shall be | ||
| 50 | transferred from the Florida Forever Trust Fund to the Florida | ||
| 51 | National Scenic Trail Trust Fund to be used for the purposes | ||
| 52 | specified in s. 260.22. Such transfer shall occur not later than | ||
| 53 | September 30, 2003, and prior to the transfer of proceeds | ||
| 54 | pursuant to s. 259.105(3). This subsection expires July 1, 2004. | ||
| 55 | Section 3. This act shall take effect July 1, 2003. | ||
