11  Senator Wasserman Schultz moved the following amendment:

13         Senate Amendment 
14         On page 158, lines 3-14, delete those lines
15  
16  and insert:  claimant's attorney not later than the date of
17  the pretrial hearing, the benefits secured shall be those
18  offered to settle each issue. If the offer to settle an issue
19  is rejected by the claimant, any claim against the carrier for
20  an attorney's fee in excess of the fee due under the terms of
21  the offer is waived on such issue unless the amount awarded at
22  trial is at least 10 percent greater than the amount specified
23  in the offer. If multiple issues are pending before the judge
24  of compensation claims, the offer of settlement shall address
25  each issue pending, and shall state explicitly whether or not
26  the offer on each issue is severable. The written offer shall
27  also unequivocally state whether or not it includes medical
28  witness fees and expenses, and all other costs associated with
29  the claim. Acceptance of an offer by a claimant shall be
30  communicated in writing to the carrier and its counsel, if
31  any. The benefits contained in the offer, excluding fees and
