1 A bill to be entitled
2          An act relating to engineering; amending s. 471.003, F.S.;
3    exempting certain persons in the defense, space, and
4    aerospace industries from licensure under ch. 471, F.S.;
5    amending s. 471.005, F.S.; defining the terms "space or
6    aerospace company" and "defense company"; amending s.
7    471.031, F.S.; clarifying that certain persons who are
8    exempt from licensure may practice engineering; clarifying
9    which professional titles such exempt persons may use;
10    providing an effective date.
11         
12          Be It Enacted by the Legislature of the State of Florida:
13         
14          Section 1. Paragraph (j) is added to subsection (2) of
15    section 471.003, Florida Statutes, to read:
16          471.003 Qualifications for practice; exemptions.--
17          (2) The following persons are not required to be licensed
18    under the provisions of this chapter as a licensed engineer:
19          (j) Any defense, space, or aerospace company, whether a
20    sole proprietorship, firm, limited liability company,
21    partnership, joint venture, joint stock association,
22    corporation, or other business entity, subsidiary, or affiliate,
23    or any employee, contract worker, subcontractor, or independent
24    contractor of the defense, space, or aerospace company who
25    provides engineering for aircraft, space launch vehicles, launch
26    services, satellites, satellite services, or other defense,
27    space, or aerospace-related product or services, or components
28    thereof.
29          Section 2. Subsections (12) and (13) are added to section
30    471.005, Florida Statutes, to read:
31          471.005 Definitions.--As used in this chapter, the term:
32          (12) "Space or aerospace company" means any business
33    entity concerned with the design, manufacture, or support of
34    aircraft, rockets, missiles, spacecraft, satellites, space
35    vehicles, space stations, space facilities, or components
36    thereof, and equipment, systems, facilities, simulators,
37    programs, products, services, and activities related thereto.
38          (13) "Defense company" means any business entity that
39    holds a valid Department of Defense contract or any business
40    entity that is a subcontractor under a valid Department of
41    Defense contract. The term includes any business entity that
42    holds valid contracts or subcontracts for products or services
43    for military use under prime contracts with the United States
44    Department of Defense, the United States Department of State, or
45    the United States Coast Guard.
46          Section 3. Subsection (1) of section 471.031, Florida
47    Statutes, is amended to read:
48          471.031 Prohibitions; penalties.--
49          (1) A person may not:
50          (a) Practice engineering unless the person is licensed or
51    exempt from licensure under this chapter.;
52          (b)1. Except as provided in subparagraph 2.,use the name
53    or title "professional engineer" or any other title,
54    designation, words, letters, abbreviations, or device tending to
55    indicate that such person holds an active license as an engineer
56    when the person is not licensed under this chapter, including,
57    but not limited to, the following titles: "agricultural
58    engineer," "air-conditioning engineer," "architectural
59    engineer," "building engineer," "chemical engineer," "civil
60    engineer," "control systems engineer," "electrical engineer,"
61    "environmental engineer," "fire protection engineer,"
62    "industrial engineer," "manufacturing engineer," "mechanical
63    engineer," "metallurgical engineer," "mining engineer,"
64    "minerals engineer," "marine engineer," "nuclear engineer,"
65    "petroleum engineer," "plumbing engineer," "structural
66    engineer," "transportation engineer," "software engineer,"
67    "computer hardware engineer," or "systems engineer.";
68          2. Any person who is exempt from licensure under s.
69    471.003(2)(j) may use the title or personnel classification of
70    "engineer" in the scope of his or her work under that exemption
71    if the title does not include or connote the term "professional
72    engineer," "registered engineer," "licensed engineer,"
73    "registered professional engineer," or "licensed professional
74    engineer."
75          (c) Present as his or her own the license of another.;
76          (d) Give false or forged evidence to the board or a member
77    thereof.;
78          (e) Use or attempt to use a license that has been
79    suspended, revoked, or placed on inactive or delinquent status.;
80          (f) Employ nonexemptunlicensed persons to practice
81    engineering.; or
82          (g) Conceal information relative to violations of this
83    chapter.
84          Section 4. This act shall take effect upon becoming a law.
