3     Amendment (with title amendment)
4     Between lines 534 and 535 insert:
5     Section 7.  Subsections (2) and (3) of section 186.504,
6Florida Statutes, are amended to read:
7     186.504  Regional planning councils; creation;
8membership.--
9     (2)  Membership on the regional planning council shall be
10as follows:
11     (a)  Representatives appointed by each of the member
12counties in the geographic area covered by the regional planning
13council.
14     (b)  Representatives from other member local general-
15purpose governments in the geographic area covered by the
16regional planning council.
17     (c)  Representatives appointed by the Governor from the
18geographic area covered by the regional planning council,
19including an elected school board member from the geographic
20area covered by the regional planning council, to be nominated
21by the Florida School Board Association.
22     (d)  For those regional planning councils within the South
23Florida Regional Transportation Authority service territory, a
24representative appointed by the South Florida Regional
25Transportation Authority.
26     (3)  Not less than two-thirds of the representatives
27serving as voting members on the governing bodies of such
28regional planning councils shall be elected officials of local
29general-purpose governments chosen by the cities and counties of
30the region, provided each county shall have at least one vote.
31The remaining one-third of the voting members on the governing
32board shall be appointed by the Governor, to include one elected
33school board member, subject to confirmation by the Senate, and
34shall reside in the region. No two appointees of the Governor
35shall have their places of residence in the same county until
36each county within the region is represented by a Governor's
37appointee to the governing board. Nothing contained in this
38section shall deny to local governing bodies or the Governor the
39option of appointing either locally elected officials or lay
40citizens provided at least two-thirds of the governing body of
41the regional planning council is composed of locally elected
42officials. In those regional planning councils within the South
43Florida Regional Transportation's service territory, the voting
44member representing the South Florida Regional Transportation
45Authority shall not be subject to the above referenced ratios
46regarding board composition.
47     Section 8.  Paragraph (b) of subsection (1) of section
48343.54, Florida Statutes, is amended to read:
49     343.54  Powers and duties.--
50     (1)
51     (b)  It is the express intention of this part that the
52authority be authorized to plan, develop, own, purchase, lease,
53or otherwise acquire, demolish, construct, improve, relocate,
54equip, repair, maintain, operate, and manage a transit system
55and transit facilities; to establish and determine the policies
56necessary for the best interest of the operation and promotion
57of a transit system; and to adopt rules necessary to govern the
58operation of a transit commuter rail system and transit commuter
59rail facilities. It is the intent of the Legislature that the
60South Florida Regional Transportation Authority shall have
61overall authority to coordinate, develop, and operate a regional
62transportation system within the area served.
63     Section 9.  Section 343.58, Florida Statutes, is amended to
64read:
65     343.58  County funding for the South Florida Regional
66Transportation Authority.--
67     (1)  Each county served by the South Florida Regional
68Transportation Authority must dedicate and transfer not less
69than $2.67 million to the authority annually. The recurring
70annual $2.67 million must be dedicated by the governing body of
71each county prior to October 31 of each fiscal year by August 1,
722003. Notwithstanding ss. 206.41 and 206.87, such dedicated
73funding may come from each county's share of the ninth-cent fuel
74tax, the local option fuel tax, or any other source of local gas
75taxes or other nonfederal funds available to the counties. In
76addition, the Legislature authorizes the levy of an annual
77license tax in the amount of $2 for the registration or renewal
78of registration of each vehicle taxed under s. 320.08 and
79registered in the area served by the South Florida Regional
80Transportation Authority. The annual license tax shall take
81effect in any county served by the authority upon approval by
82the residents in a county served by the authority. The annual
83license tax shall be levied and the Department of Highway Safety
84and Motor Vehicles shall remit the proceeds each month from the
85tax to the South Florida Regional Transportation Authority.
86     (2)  In addition, each county shall continue to annually
87fund the operations of the South Florida Regional Transportation
88Authority in an amount not less than $1.565 million. Such funds
89pursuant to this subsection shall also be considered a dedicated
90funding source.

92If, by December 31, 2009, the South Florida Regional
93Transportation Authority has not received federal matching funds
94based upon the dedication of funds under subsection (1),
95subsection (1) shall be repealed.

104language; amending s. 343.58, F.S.; revising provisions for
105dedication and transfer of certain funds to the South Florida
106Regional Transportation Authority; revising timeframe for such
107transfers; providing an effective date.
