1 A bill to be entitled
2          An act relating to prescriptions for medicinal drugs;
3    creating s. 456.0392, F.S.; requiring certain
4    practitioners to include specified information on
5    prescriptions; providing that certain prescriptions shall
6    be presumed valid; providing an effective date.
7         
8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Section 456.0392, Florida Statutes, is created
11    to read:
12          456.0392 Prescription labeling.--
13          (1) A prescription written by a practitioner who is
14    authorized under the laws of this state to write prescriptions
15    for drugs that are not listed as controlled substances in
16    chapter 893 but who is not eligible for a federal Drug
17    Enforcement Administration number shall include that
18    practitioner's name and professional license number. The
19    pharmacist or dispensing practitioner must include the
20    practitioner's name on the container of the drug that is
21    dispensed. A pharmacist shall be permitted, upon verification by
22    the prescriber, to document any information required by this
23    section.
24          (2) A prescription for a drug that is not listed as a
25    controlled substance in chapter 893 which is written by an
26    advanced registered nurse practitioner certified under s.
27    464.012 is presumed, subject to rebuttal, to be valid and within
28    the parameters of the prescriptive authority delegated by a
29    practitioner licensed under chapter 458, chapter 459, or chapter
30    466.
31          (3) A prescription for a drug that is not listed as a
32    controlled substance in chapter 893 which is written by a
33    physician assistant licensed under chapter 458 or chapter 459 is
34    presumed, subject to rebuttal, to be valid and within the
35    parameters of the prescriptive authority delegated by the
36    physician assistant's supervising physician.
37          Section 2. This act shall take effect July 1, 2004.
