A bill to be entitled
2An act relating to prescriptions for medicinal drugs;
3creating s. 456.0392, F.S.; requiring certain
4practitioners to include specified information on
5prescriptions; providing that certain prescriptions shall
6be presumed valid; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Section 456.0392, Florida Statutes, is created
11to read:
12     456.0392  Prescription labeling.--
13     (1)  A prescription written by a practitioner who is
14authorized under the laws of this state to write prescriptions
15for drugs that are not listed as controlled substances in
16chapter 893 but who is not eligible for a federal Drug
17Enforcement Administration number shall include that
18practitioner's name and professional license number. The
19pharmacist or dispensing practitioner must include the
20practitioner's name on the container of the drug that is
21dispensed. A pharmacist shall be permitted, upon verification by
22the prescriber, to document any information required by this
23section.
24     (2)  A prescription for a drug that is not listed as a
25controlled substance in chapter 893 which is written by an
26advanced registered nurse practitioner certified under s.
27464.012 is presumed, subject to rebuttal, to be valid and within
28the parameters of the prescriptive authority delegated by a
29practitioner licensed under chapter 458, chapter 459, or chapter
30466.
31     (3)  A prescription for a drug that is not listed as a
32controlled substance in chapter 893 which is written by a
33physician assistant licensed under chapter 458 or chapter 459 is
34presumed, subject to rebuttal, to be valid and within the
35parameters of the prescriptive authority delegated by the
36physician assistant's supervising physician.
37     Section 2.  This act shall take effect July 1, 2004.
