A bill to be entitled
2An act relating to automated pharmacy systems; amending s.
3465.003, F.S.; defining the term "automated pharmacy
4system" for purposes of the Florida Pharmacy Act; creating
5s. 465.0235, F.S.; authorizing a pharmacy to provide
6services to a long-term care facility licensed under ch.
7400, F.S., or a state correctional institution operated
8under ch. 944, F.S., through an automated pharmacy system;
9providing that drugs dispensed from an automated pharmacy
10system are considered to have been dispensed by the
11pharmacy that services a long-term care facility or
12correctional institution; requiring that the operation of
13an automated pharmacy system be under the supervision of a
14pharmacist; requiring the Board of Pharmacy to adopt
15rules; providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  Subsection (17) is added to section 465.003,
20Florida Statutes, to read:
21     465.003  Definitions.--As used in this chapter, the term:
22     (17)  "Automated pharmacy system" means a mechanical system
23that dispenses prescription drugs and maintains related
24transaction information.
25     Section 2.  Section 465.0235, Florida Statutes, is created
26to read:
27     465.0235  Automated pharmacy systems used by long-term care
28facilities or state correctional institutions.--
29     (1)  A pharmacy may provide pharmacy services to a long-
30term care facility licensed under chapter 400 or a state
31correctional institution operated under chapter 944 through the
32use of an automated pharmacy system that need not be located at
33the same location as the pharmacy.
34     (2)  Medicinal drugs stored in bulk or unit of use in an
35automated pharmacy system servicing a long-term care facility or
36correctional institution are part of the inventory of the
37pharmacy providing pharmacy services to that facility or
38institution, and drugs dispensed from the automated pharmacy
39system are considered to have been dispensed by that pharmacy.
40     (3)  The operation of an automated pharmacy system must be
41under the supervision of a licensed pharmacist. To qualify as a
42supervisor for an automated pharmacy system, the pharmacist need
43not be physically present at the site of the automated pharmacy
44system and may supervise the system electronically.
45     (4)  The board shall adopt rules governing the use of an
46automated pharmacy system by January 1, 2005, which must
47specify:
48     (a)  Recordkeeping requirements;
49     (b)  Security requirements; and
50     (c)  Labeling requirements that permit the use of unit-dose
51medications if the facility or institution maintains medication-
52administration records that include directions for use of the
53medication and the automated pharmacy system identifies:
54     1.  The dispensing pharmacy;
55     2.  The prescription number;
56     3.  The name of the patient; and
57     4.  The name of the prescribing practitioner.
58     Section 3.  This act shall take effect upon becoming a law.
