  1                      A bill to be entitled

  2         An act relating to use of social security

  3         numbers in public postsecondary education;

  4         creating s. 1004.09, F.S.; prohibiting certain

  5         uses of a student's social security number by

  6         state universities, community colleges, and

  7         public postsecondary technical centers;

  8         prohibiting public disclosure; providing

  9         exceptions; requiring the development and

10         implementation of a plan by each state

11         university, community college, and public

12         postsecondary technical center; providing for

13         injunctive relief; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Section 1004.09, Florida Statutes, is

18  created to read:

19         1004.09  Improper use of social security numbers.--

20         (1)  No state university, community college, or public

21  postsecondary technical center shall:

22         (a)  Use a social security number as an identification

23  number to publicly identify a student. For purposes of

24  employment, financial aid, research, assessment,

25  accountability, transcripts, or as otherwise required by state

26  or federal law, a state university, community college, or

27  public postsecondary technical center may collect, use, and

28  report to the Department of Education a student's social

29  security number, as long as the social security number is not

30  publicly disclosed.

 1         (b)  Publicly post or publicly display in any manner a

 2  student's social security number. "Publicly post" or "publicly

 3  display" means to intentionally communicate or otherwise make

 4  available to the general public. This paragraph does not apply

 5  to records of the clerks of court which are governed by the

 6  provisions of s. 119.07(3)(ff).

 7         (c)  Print a student's social security number on any

 8  identification document issued by a state university,

 9  community college, or public postsecondary technical center.

10  An identification document includes, but is not limited to, a

11  professional license, student identification card, driver's

12  license, Medicaid card, or health insurance card.

13         (d)  Require a student to transmit his or her social

14  security number over the Internet unless the connection is

15  secure and the social security number is encrypted.

16         (e)  Require a student to use his or her social

17  security number to access an Internet website unless a

18  password or unique personal identification number or other

19  authentication device is also required to access the Internet

20  website.

21         (2)  Each state university, community college, and

22  public postsecondary technical center shall develop a plan to

23  implement the requirements of subsection (1) which shall apply

24  to students enrolled after July 1, 2005. The plan shall

25  include provisions for educating staff regarding the proper

26  and improper uses of social security numbers. The plan shall

27  be submitted to the Governor, the President of the Senate, and

28  the Speaker of the House of Representatives by February 1,

29  2005, and shall be implemented no later than July 1, 2005.

 1         (3)  Beginning July 1, 2005, any affected student may

 2  petition the circuit court for an order directing compliance

 3  with this section.

 4         Section 2.  This act shall take effect July 1, 2004.

 6          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 7                         Senate Bill 1218

 8                                 

 9  The committee substitute provides for exceptions to the
    prohibited uses of a student's social security number for
10  purposes of employment, financial aid, research, assessment,
    accountability, transcripts, or as otherwise required by state
11  or federal law if the student's social security number is not
    publicly disclosed. The committee substitute requires public
12  postsecondary technical centers to comply with the provisions
    of the bill.
