  1                      A bill to be entitled

  2         An act relating to the Chief of Domestic

  3         Security Initiatives; amending s. 943.0311,

  4         F.S.; providing for security assessments of all

  5         buildings, facilities, and structures owned or

  6         occupied by state agencies, state universities,

  7         and community colleges, by the employees and

  8         within existing resources of such state

  9         agencies, state universities, or community

10         colleges; requiring completion of initial

11         security assessments by a specified date;

12         providing for subsequent security assessments;

13         providing for reports; requiring the chief to

14         communicate to local governments and water

15         management districts regarding security

16         assessments of buildings and facilities;

17         providing that costs of security assessments of

18         local government buildings and facilities shall

19         be borne by the local government or water

20         management district; providing an effective

21         date.

23  Be It Enacted by the Legislature of the State of Florida:

24  

25         Section 1.  Section 943.0311, Florida Statutes, is

26  amended to read:

27         943.0311  Chief of Domestic Security Initiatives; and

28  the department's duties of the department with respect to

29  domestic security.--

 1         (1)  The executive director of the department, or a

 2  member of the department designated by the executive director,

 3  shall serve as the Chief of Domestic Security Initiatives.

 4         (1)  The Chief of Domestic Security Initiatives shall:

 5         (a)  Coordinate the efforts of the department in the

 6  ongoing assessment of this state's vulnerability to, and

 7  ability to detect and respond to, acts of terrorism, as

 8  defined in s. 775.30, within or affecting this state.

 9         (b)  Prepare recommendations for the Executive Office

10  of the Governor, the President of the Senate, and the Speaker

11  of the House of Representatives, which are based upon ongoing

12  assessments to limit the vulnerability of the state to

13  terrorism.

14         (c)  Coordinate the collection of proposals to limit

15  the vulnerability of the state to terrorism.

16         (d)  Use regional task forces to support the duties of

17  the department set forth in this section.

18         (e)  Use public or private resources to perform the

19  duties assigned to the department under this section.

20         (f)  Perform other duties assigned by law.

21         (2)(a)  The chief shall conduct or cause to be

22  conducted by the personnel and with the resources of the state

23  agency, state university, or community college that owns or

24  leases a building, facility, or structure, specific security

25  assessments of buildings, and facilities, and structures owned

26  or leased by state agencies, state universities, and community

27  colleges. Each state agency, state university, and community

28  college or local governments. All state agencies and local

29  governments shall cooperate with the department and provide

30  the assistance of employees within existing resources to

31  provide to the chief information in the format requested by

 1  the chief. The chief must report to the Governor, the

 2  President of the Senate, and the Speaker of the House of

 3  Representatives if any state agency, state university, or

 4  community college substantially fails to cooperate with the

 5  chief in making a security assessment of the buildings,

 6  facilities, and structures of the state agency, state

 7  university, or community college.

 8         (a)  The initial assessment of each building, facility,

 9  or structure owned or leased by a state agency, state

10  university, or community college shall be completed by the

11  state agency, state university, or community college and shall

12  be provided to the chief no later than November 1, 2004.

13         (b)  The chief may request followup assessments to

14  ensure that the security assessments of buildings, facilities,

15  and structures, owned or leased by state agencies, state

16  universities, and community colleges, remain reasonably

17  current and valid. requested information and resources to

18  assist the department in meeting its responsibilities under

19  this section.

20         (b)  Based upon the security assessments, the chief

21  shall prepare recommendations to enhance the security of

22  buildings and facilities owned or leased by state agencies or

23  local governments.

24         (3)(c)  The chief shall report to the Executive Office

25  of the Governor, the President of the Senate, and the Speaker

26  of the House of Representatives by November 1 of each year

27  prioritized suggestions for specific security enhancement of

28  recommended minimum security standards or security-enhancement

29  needs for any building, or facility, or structure owned or

30  leased by a state agency, state university, or community

31  college or local government. The report must identify and

 1  prioritize the recommended security enhancements and provide

 2  recommendations to maximize federal funding in support of

 3  building and facility security.

 4         (4)(3)  The chief shall report develop and submit to

 5  the Executive Office of the Governor, the President of the

 6  Senate, and the Speaker of the House of Representatives

 7  recommended best practices for safety and security of

 8  buildings, facilities, and structures owned or leased by state

 9  agencies, state universities, community colleges, and local

10  governments. To promote the continued safety of government

11  buildings, facilities, and structures within the state, the

12  best practices may be revised or enhanced by the chief as

13  necessary. The recommended best practices are not a rule as

14  defined in chapter 120.

15         (5)  The chief shall communicate to local governments

16  and water management districts the importance of conducting

17  security assessments of buildings, facilities, and structures

18  owned or leased by such local governments or water management

19  districts, and the options local governments and water

20  management districts should consider in obtaining security

21  assessments. The cost of any security assessment of a

22  building, facility, or structure owned or leased by a local

23  government or water management district shall be borne by the

24  local government or water management district, as applicable.

25  The chief shall review the recommended best practices as

26  necessary, but at least once each year, and shall submit any

27  recommended changes to the Executive Office of the Governor,

28  the President of the Senate, and the Speaker of the House of

29  Representatives.

30         (6)(4)  The chief may conduct specific security

31  assessments of a building or facility owned by a private

 1  entity upon the request of that private entity. The chief may

 2  prioritize requests, and such prioritization is not agency

 3  action that is subject to review under chapter 120. The chief

 4  may solicit private entities for the purpose of receiving

 5  requests to perform security assessments of buildings or

 6  facilities. Private entities are urged to cooperate with and

 7  assist the department in meeting its responsibilities for

 8  domestic security.

 9         (5)  By November 1 of each year, the executive director

10  shall compile, coordinate, and prioritize recommendations and

11  proposals concerning security and shall present the

12  recommendations and proposals to the Executive Office of the

13  Governor, the President of the Senate, and the Speaker of the

14  House of Representatives. All recommendations seeking funding

15  shall be prioritized, with critical domestic security needs

16  requiring immediate or top-priority funding being clearly

17  identified. Such recommendations shall include recommendations

18  to maximize federal funding in support of the state's

19  domestic-security efforts.

20         Section 2.  This act shall take effect upon becoming a

21  law.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 124

 4  The committee substitute requires submission of initial
    security assessments by state agencies, state universities,
 5  and community colleges, to the Chief of Domestic Security
    Initiatives by November 1, 2004, rather than December 1, 2004.
 6  
    The committee substitute requires the Chief of Domestic
 7  Security Initiatives to communicate to water management
    districts options to consider in obtaining security
 8  assessments of buildings, facilities, and structures owned or
    leased by the water management districts.

    The committee substitute provides that the cost of said
10  security assessments shall be borne by the water management
    districts.
