| 6 | An act relating to traffic control; amending s. 316.1945, |
| 7 | F.S.; prohibiting stopping a vehicle in a school safety |
| 8 | zone during school hours, except in a designated loading |
| 9 | or unloading area; permitting parking in school safety |
| 10 | zones; defining "school hours" and "school safety zone"; |
| 11 | providing an effective date. |

| 13 | Be It Enacted by the Legislature of the State of Florida: |
| 14 |
|
| 15 | Section 1. Paragraph (d) is added to subsection (1) of |
| 16 | section 316.1945, Florida Statutes, to read: |
| 17 | 316.1945 Stopping, standing, or parking prohibited in |
| 18 | specified places.-- |
| 19 | (1) Except when necessary to avoid conflict with other |
| 20 | traffic, or in compliance with law or the directions of a police |
| 21 | officer or official traffic control device, no person shall: |
| 22 | (d) Stop a vehicle to load or unload any passenger in a |
| 23 | school safety zone during school hours, except in a designated |
| 24 | loading or unloading area. Parking is not prohibited by this |
| 25 | paragraph. For purposes of this paragraph, the term "school |
| 26 | hours" means all times during which the school is open and is |
| 27 | staffed by instructional personnel, administrative personnel, or |
| 28 | educational support employees, and the term "school safety zone" |
| 29 | means in, on, or within 500 feet of any real property owned by |
| 30 | or leased to any school district or public or private elementary |
| 31 | school and used for elementary school education. |
| 32 | Section 2. This act shall take effect July 1, 2004. |
