4     Remove everything after the enacting clause and insert:
5     Section 1.  Subsection (5) of section 17.41, Florida
6Statutes, is reenacted to read:
7     17.41  Department of Financial Services Tobacco Settlement
8Clearing Trust Fund.--
9     (5)  The department shall disburse funds, by nonoperating
10transfer, from the Tobacco Settlement Clearing Trust Fund to the
11tobacco settlement trust funds of the various agencies in
12amounts equal to the annual appropriations made from those
13agencies' trust funds in the General Appropriations Act.
14     Section 2.  Paragraph (h) of subsection (1) of section
1520.435, Florida Statutes, as amended by section 2 of chapter
162003-421, Laws of Florida, is reenacted to read:
17     20.435  Department of Health; trust funds.--
18     (1)  The following trust funds are hereby created, to be
19administered by the Department of Health:
20     (h)  Biomedical Research Trust Fund.
21     1.  Funds to be credited to the trust fund shall consist of
22funds deposited pursuant to s. 215.5601. Funds shall be used for
23the purposes of the James and Esther King Biomedical Research
24Program as specified in ss. 215.5602 and 288.955. The trust fund
25is exempt from the service charges imposed by s. 215.20.
26     2.  Notwithstanding the provisions of s. 216.301 and
27pursuant to s. 216.351, any balance in the trust fund at the end
28of any fiscal year shall remain in the trust fund at the end of
29the year and shall be available for carrying out the purposes of
30the trust fund.
31     3.  The trust fund shall, unless terminated sooner, be
32terminated on July 1, 2008.
33     Section 3.  Paragraph (e) of subsection (5) of section
34215.5601, Florida Statutes, is reenacted to read:
35     215.5601  Lawton Chiles Endowment Fund.--
36     (5)  AVAILABILITY OF FUNDS; USES.--
37     (e)  Notwithstanding s. 216.301 and pursuant to s. 216.351,
38all unencumbered balances of appropriations as of June 30 or
39undisbursed balances as of December 31 shall revert to the
40endowment's principal. Unencumbered or undisbursed balances
41appropriated for biomedical research shall revert to the
42principal in the separately reserved and accounted-for portion
43of the endowment established for biomedical research activities.
44     Section 4.  This act shall take effect July 1, 2004.
