| 7 | 320.08058, F.S.; creating an Omega Psi Phi Fraternity |

| 9 | use fees received from the sale of such plates; providing |
| 10 | an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Paragraph (ss) is added to subsection (4) of |
| 15 | section 320.08056, Florida Statutes, to read: |
| 16 | 320.08056 Specialty license plates.-- |
| 17 | (4) The following license plate annual use fees shall be |
| 18 | collected for the appropriate specialty license plates: |
| 19 | (ss) Omega Psi Phi Fraternity license plate, $25. |
| 20 | Section 2. Subsection (45) is added to section 320.08058, |
| 21 | Florida Statutes, to read: |
| 22 | 320.08058 Specialty license plates.-- |
| 23 | (45) OMEGA PSI PHI FRATERNITY LICENSE PLATES.-- |
| 24 | (a) Notwithstanding the provisions of s. 320.08053(1)(b), |
| 25 | the department shall develop an Omega Psi Phi Fraternity license |
| 26 | plate as provided in this section. The word "Florida" must |
| 27 | appear at the top of the plate, and the words "Omega Psi Phi |
| 28 | Fraternity" must appear at the bottom of the plate. |
| 29 | (b) The department shall retain all revenues up to $60,000 |
| 30 | from the sale of such plates until all startup costs for |
| 31 | developing and issuing the plates have been recovered. |
| 32 | Thereafter, the annual use fees shall be distributed to the |
| 33 | Florida State Omega Scholarship Fund to be distributed by Omega |
| 34 | Psi Phi for scholarships to deserving students. |
| 35 | Section 3. This act shall take effect July 1, 2004. |
