  1                      A bill to be entitled

  2         An act relating to automated pharmacy systems;

  3         amending s. 465.003, F.S.; defining the term

  4         "automated pharmacy system" for purposes of the

  5         Florida Pharmacy Act; creating s. 465.0235,

  6         F.S.; authorizing a pharmacy to provide

  7         services to a long-term care facility or

  8         hospice licensed under ch. 400, F.S., or a

  9         state correctional institution operated under

10         ch. 944, F.S., through an automated pharmacy

11         system; providing that drugs dispensed from an

12         automated pharmacy system are considered to

13         have been dispensed by the pharmacy that

14         services a long-term care facility, hospice, or

15         correctional institution; requiring that the

16         operation of an automated pharmacy system be

17         under the supervision of a pharmacist;

18         requiring the Board of Pharmacy to adopt rules;

19         providing an effective date.

21  Be It Enacted by the Legislature of the State of Florida:

22  

23         Section 1.  Subsection (17) is added to section

24  465.003, Florida Statutes, to read:

25         465.003  Definitions.--As used in this chapter, the

26  term:

27         (17)  "Automated pharmacy system" means a mechanical

28  system that dispenses prescription drugs and maintains related

29  transaction information.

30         Section 2.  Section 465.0235, Florida Statutes, is

 1         465.0235  Automated pharmacy systems used by long-term

 2  care facilities or state correctional institutions.--

 3         (1)  A pharmacy may provide pharmacy services to a

 4  long-term care facility or hospice licensed under chapter 400

 5  or a state correctional institution operated under chapter 944

 6  through the use of an automated pharmacy system that need not

 7  be located at the same location as the pharmacy.

 8         (2)  Medicinal drugs stored in bulk or unit of use in

 9  an automated pharmacy system servicing a long-term care

10  facility, hospice, or correctional institution are part of the

11  inventory of the pharmacy providing pharmacy services to that

12  facility or institution, and drugs dispensed from the

13  automated pharmacy system are considered to have been

14  dispensed by that pharmacy.

15         (3)  The operation of an automated pharmacy system must

16  be under the supervision of a pharmacist. To qualify as a

17  supervisor for an automated pharmacy system, the pharmacist

18  need not be physically present at the site of the automated

19  pharmacy system and may supervise the system electronically.

20         (4)  The board shall adopt rules governing the use of

21  an automated pharmacy system by January 1, 2005, which must

22  specify:

23         (a)  Recordkeeping requirements;

24         (b)  Security requirements; and

25         (c)  Labeling requirements that permit the use of

26  unit-dose medications if the facility or institution maintains

27  medication-administration records that include directions for

28  use of the medication and the automated pharmacy system

29  identifies:

30         1.  The dispensing pharmacy;

31         2.  The prescription number;

 1         3.  The name of the patient; and

 2         4.  The name of the prescribing practitioner.

 3         Section 3.  This act shall take effect upon becoming a

 4  law.

 6          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN

 9  The Committee Substitute adds hospices to the entities in
    which a pharmacy may provide pharmacy services through the use
10  of an automated pharmacy system.
