  1                      A bill to be entitled

  2         An act relating to renewable energy; creating

  3         s. 366.8155, F.S.; providing definitions for

  4         purposes of ss. 366.80-366.85 and 403.519,

  5         F.S., the Florida Energy Efficiency and

  6         Conservation Act; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 366.8155, Florida Statutes, is

11  created to read:

12         366.8155  Definitions relating to renewable energy

13  sources.--As used in ss. 366.80-366.85 and 403.519, the term:

14         (1)  "Biomass" means a power source that is comprised

15  of, but not limited to, combustible residues or gasses from

16  forest-products manufacturing, agricultural and orchard crops,

17  waste products from livestock and poultry operations or food

18  processing, urban wood waste, municipal solid waste, municipal

19  liquid-waste-treatment operations, and landfill gasses.

20         (2)  "Renewable energy" means energy produced from any

21  method or process that uses one or more of the following

22  sources of energy: fuel cells, biomass, solar thermal or

23  gradient power, hydroelectric power, landfill gasses,

24  agricultural products and byproducts, and waste heat from

25  exothermic reactions.

26         Section 2.  This act shall take effect October 1, 2004.

30    Defines the terms "biomass" and "renewable energy" for
      purposes of the Florida Energy Efficiency and
31    Conservation Act.
