| 4 | Emerald Coast Utilities Authority and transferring all |
| 5 | powers, duties, assets, and liabilities of the authority |
| 6 | to the Emerald Coast Utilities Authority, a Charter |
| 7 | Agency, created by the Charter for Escambia County; |
| 8 | providing for employees of the authority to become |
| 9 | employees of the Charter Agency; providing for referendum |
| 10 | approval; providing a contingent effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |

| 14 | Section 1. Chapter 2001-324, Laws of Florida, as amended, |
| 15 | is repealed. |
| 16 | Section 2. On the effective date of this act, all powers, |
| 17 | duties, assets, and liabilities of the Emerald Coast Utilities |
| 18 | Authority are transferred to the Emerald Coast Utilities |
| 19 | Authority, a Charter Agency, created by the Charter for Escambia |
| 20 | County approved by a majority of the voters of Escambia County |
| 21 | in a referendum election on March 9, 2004. On the effective date |
| 22 | of this act, employees of the Emerald Coast Utilities Authority |
| 23 | shall become employees of the Charter Agency. |
| 24 | Section 3. This act shall take effect November 15, 2004, |
| 25 | if HB 401 or similar legislation is adopted in the same |
| 26 | legislative session or an extension thereof and becomes law, and |
| 27 | if the Charter for Escambia County is approved by a majority of |
| 28 | the voters of Escambia County in a referendum election on March |
| 29 | 9, 2004. |
