| 7 | 290.0065, F.S.; authorizing certain counties to apply to  | 
| 8 | the Office of Tourism, Trade, and Economic Development to  | 
| 9 | amend existing enterprise zone boundaries under specified  | 
| 10 | conditions and in accordance with certain criteria;  | 
| 11 | creating s. 290.00703, F.S.; authorizing the City of  | 
| 12 | South Daytona to apply to the Office of Tourism, Trade,  | 
| 13 | and Economic Development to designate an enterprise zone  | 
| 14 | within an area of the City of South Daytona; authorizing  | 
| 15 | the Office of Tourism, Trade, and Economic Development to  | 
| 16 | designate one enterprise zone in the City of South  | 
| 17 | Daytona; providing requirements with respect thereto;  | 
| 18 | authorizing the governing body of certain counties to  | 
| 19 | apply to the Office of Tourism, Trade, and Economic  | 
| 20 | Development to amend the boundaries of a certain area  | 
| 21 | within a certain enterprise zone; requiring the office to  | 
| 22 | approve the application under certain circumstances;  | 
| 23 | providing requirements; providing an effective date. | 
| 24 |

| 25 | Be It Enacted by the Legislature of the State of Florida: | 
| 26 | 
  | 
| 27 |      Section 1.  Subsection (12) is added to section 290.0065,  | 
| 28 | Florida Statutes, to read: | 
| 29 |      290.0065  State designation of enterprise zones.-- | 
| 30 |      (12)  Before November 30, 2004, any county as defined in s.  | 
| 31 | 125.011 may apply to the Office of Tourism, Trade, and Economic  | 
| 32 | Development to change the boundaries of an existing enterprise  | 
| 33 | zone for the purpose of replacing an area of not more than 75  | 
| 34 | acres within the enterprise zone as of January 1, 2004, with an  | 
| 35 | area of the same number of acres outside the enterprise zone as  | 
| 36 | of January 1, 2004. The replacement area must be contiguous to  | 
| 37 | the existing enterprise zone and must be a part of a  | 
| 38 | revitalization area that has been targeted for assistance by the  | 
| 39 | county. The replacement area also must be contiguous to a zoo  | 
| 40 | and the county must have previously completed a master plan for  | 
| 41 | development of the area. The Office of Tourism, Trade, and  | 
| 42 | Economic Development shall approve the amendment effective  | 
| 43 | January 1, 2005, if the enterprise zone remains consistent with  | 
| 44 | the criteria and conditions imposed by s. 290.0055 upon the  | 
| 45 | establishment of enterprise zones, including the requirement  | 
| 46 | that the area suffer from pervasive poverty, unemployment, and  | 
| 47 | general distress. | 
| 48 |      Section 2.  Section 290.00703, Florida Statutes, is created  | 
| 49 | to read: | 
| 50 |      290.00703  Enterprise zone designation for the City of  | 
| 51 | South Daytona.--The City of South Daytona may apply to the  | 
| 52 | Office of Tourism, Trade, and Economic Development for  | 
| 53 | designation of one enterprise zone within the city. The  | 
| 54 | application must be submitted by December 31, 2004, and must  | 
| 55 | comply with the requirements of s. 290.0055. Notwithstanding the  | 
| 56 | provisions of s. 290.0065 limiting the total number of  | 
| 57 | enterprise zones designated and the number of enterprise zones  | 
| 58 | within a population category, the Office of Tourism, Trade, and  | 
| 59 | Economic Development may designate one enterprise zone under  | 
| 60 | this section. The Office of Tourism, Trade, and Economic  | 
| 61 | Development shall establish the initial effective date of the  | 
| 62 | enterprise zone designated under this section. | 
| 63 |      Section 3.  Notwithstanding any other provision of chapter  | 
| 64 | 290, Florida Statutes, the governing body of any inland county,  | 
| 65 | with a state-designated enterprise zone and a population greater  | 
| 66 | than 500,000, may apply to the Office of Tourism, Trade, and  | 
| 67 | Economic Development to amend the boundaries of such an  | 
| 68 | enterprise zone. The increased areas shall be contiguous to the  | 
| 69 | existing enterprise zone. The office shall approve the  | 
| 70 | application as long as the amended area does not exceed 5 square  | 
| 71 | miles and is consistent with the categories, criteria, and  | 
| 72 | limitations imposed by s. 290.0055, Florida Statutes, upon the  | 
| 73 | establishment of such enterprise zone. The enterprise zone  | 
| 74 | boundary amendment application must be received before December  | 
| 75 | 31, 2004. | 
| 76 |      Section 4.  This act shall take effect July 1, 2004. |
