A bill to be entitled
2An act relating to land surveying and mapping; amending s.
3472.019, F.S.; authorizing and providing conditions,
4including fees, for the reinstatement and reissuance of
5licenses for certain individuals whose licenses became
6null under specified circumstances; providing an effective
7date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 472.019, Florida Statutes, is amended
12to read:
13     472.019  Reactivation; continuing education;
14reinstatement.--
15     (1)  The continuing education requirements for reactivating
16a license may not exceed 12 classroom hours for each year the
17license was inactive.
18     (2)  The board shall promulgate rules relating to licenses
19which have become inactive and for the renewal of inactive
20licenses. The board shall prescribe by rule a fee not to exceed
21$50 for the reactivation of an inactive license and a fee not to
22exceed $50 for the renewal of an inactive license.
23     (3)  Notwithstanding the provisions of s. 455.271, the
24board shall reinstate and the department shall reissue the
25license of an individual whose license has become null, provided
26all of the following circumstances and qualifications are met:
27     (a)  The individual's license was scheduled to be renewed
28during the biennium period beginning in 2001.
29     (b)  The individual did not receive actual timely license
30renewal notice, as attested to by a signed and notarized
31affidavit of the individual.
32     (c)  The license of the individual was in good standing at
33the time of the beginning of the renewal cycle.
34     (d)  The individual properly petitioned the department for
35relief relating to the circumstances under which the license
36became null.
37     (e)  The department failed to grant or deny the license
38renewal petition within 90 days after receiving the petition, as
39required by the Administrative Procedure Act and s. 120.542.
40     (f)  No felony or practice act or unlicensed activity
41penalties have been imposed upon the individual for violations
42occurring during the period the license was null.

44The individual shall submit an application to the board for
45reinstatement in a manner prescribed by rules of the board and
46shall pay the appropriate application fees in an amount equal to
47the fees imposed for current applicants for new licensure.
48     Section 2.  This act shall take effect July 1, 2004.
