A bill to be entitled
2An act relating to land surveying and mapping; amending s.
3472.019, F.S.; authorizing and providing conditions,
4including fees, for the reinstatement and reissuance of
5licenses for certain individuals whose licenses became
6null under specified circumstances; providing for future
7repeal; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:
10
11     Section 1.  Section 472.019, Florida Statutes, is amended
12to read:
13     472.019  Reactivation; continuing education;
14reinstatement.--
15     (1)  The continuing education requirements for reactivating
16a license may not exceed 12 classroom hours for each year the
17license was inactive.
18     (2)  The board shall promulgate rules relating to licenses
19which have become inactive and for the renewal of inactive
20licenses. The board shall prescribe by rule a fee not to exceed
21$50 for the reactivation of an inactive license and a fee not to
22exceed $50 for the renewal of an inactive license.
23     (3)  Notwithstanding the provisions of s. 455.271, the
24board shall reinstate and the department shall reissue by July
251, 2005, the license of an individual whose license has become
26null, provided all of the following circumstances and
27qualifications are met:
28     (a)  The individual's license was scheduled to be renewed
29during the biennium period beginning in 2001.
30     (b)  The individual did not receive actual timely license
31renewal notice, as attested to by a signed and notarized
32affidavit of the individual.
33     (c)  The license of the individual was in good standing at
34the time of the beginning of the renewal cycle.
35     (d)  The individual properly petitioned the department for
36relief relating to the circumstances under which the license
37became null.
38     (e)  The department failed to grant or deny the license
39renewal petition within 90 days after receiving the petition, as
40required by the Administrative Procedure Act and s. 120.542.
41     (f)  No felony or practice act or unlicensed activity
42penalties have been imposed upon the individual for violations
43occurring during the period the license was null.

45The individual shall submit an application to the board for
46reinstatement in a manner prescribed by rules of the board and
47shall pay the appropriate application fees in an amount equal to
48the fees imposed for current applicants for new licensure. This
49subsection expires July 1, 2005.
50     Section 2.  This act shall take effect July 1, 2004.
