| 14 | Be It Enacted by the Legislature of the State of Florida: |
| 15 |
|
| 16 | Section 1. As used in this act: |
| 17 | (1) "Public body" means any entity created by the State |
| 18 | Constitution, by general or special law, or by ordinance and |
| 19 | operating solely within the geographic boundaries of |
| 20 | Hillsborough County, excluding agencies as defined in s. |
| 21 | 287.012(1), Florida Statutes. |
| 22 | (2) "Bid" means a bid or proposal. |
| 23 | Section 2. The purpose of this act is to facilitate the |
| 24 | purchase of goods and services by a public body by enabling a |
| 25 | public body to engage in cooperative purchasing practices with |
| 26 | other federal, state, and local governmental entities. |
| 27 | Section 3. A public body may make purchases of goods and |
| 28 | services from contracts procured by any other federal, state, or |
| 29 | local governmental entity under the terms of a bid submitted to |
| 30 | such entity, provided that such contract is procured in |
| 31 | compliance with the procuring entity's laws, bylaws, rules, |
| 32 | regulations, or ordinances regarding competitive solicitation, |
| 33 | which must provide for full and open competition. |
| 34 | Section 4. Any purchase made in compliance with the |
| 35 | provisions of this act is exempt from the competitive |
| 36 | solicitation requirements of the public entity otherwise |
| 37 | applicable to such purchase. |
| 38 | Section 5. This act provides a supplemental, additional, |
| 39 | and alternative method of purchasing and is not in derogation of |
| 40 | any purchasing powers now existing, including the powers |
| 41 | provided for in chapter 69-1119, Laws of Florida. This act does |
| 42 | not exempt public bodies subject to s. 287.055, Florida |
| 43 | Statutes, from compliance with that section. |
| 44 | Section 6. This act shall take effect upon becoming a law. |
