14         On page 75, line 24, through
15            page 76, line 21, delete those lines

17  and insert:  
18         395.003  Licensure; issuance, renewal, denial,
19  modification, suspension, and revocation.--
20         (1)(a)  A No person may not shall establish, conduct,
21  or maintain a hospital, ambulatory surgical center, or mobile
22  surgical facility in this state without first obtaining a
23  license under this part.
24         (b)1.  It is unlawful for a any person to use or
25  advertise to the public, in any way or by any medium
26  whatsoever, any facility as a "hospital," "ambulatory surgical
27  center," or "mobile surgical facility" unless such facility
28  has first secured a license under the provisions of this part.
29         2.  Nothing in This part does not apply applies to
30  veterinary hospitals or to commercial business establishments
31  using the word "hospital," "ambulatory surgical center," or

SENATE AMENDMENT Bill No. CS for CS for CS for SB 1680 Amendment No. ___ Barcode 325238 1 "mobile surgical facility" as a part of a trade name if no 2 treatment of human beings is performed on the premises of such 3 establishments. 4 3. By December 31, 2004, the agency shall submit a 5 report to the President of the Senate and the Speaker of the 6 House of Representatives recommending whether it is in the 7 public interest to allow a hospital to license or operate an 8 emergency department located off the premises of the hospital. 9 If the agency finds it to be in the public interest, the 10 report shall also recommend licensure criteria for such 11 medical facilities, including criteria related to quality of 12 care and, if deemed necessary, the elimination of the 13 possibility of confusion related to the service capabilities 14 of such facility in comparison to the service capabilities of 15 an emergency department located on the premises of the 16 hospital.
