| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |

| 13 | Section 1. Section 1013.352, Florida Statutes, is created |
| 14 | to read: |
| 15 | 1013.352 School district exemption from educational |
| 16 | facilities construction and funding standards.--Notwithstanding |
| 17 | any other provision of law, a school district may exempt itself |
| 18 | from Department of Education educational facilities construction |
| 19 | and funding standards and adopt alternative standards upon |
| 20 | approval by a majority of the electors of the school district |
| 21 | voting in a referendum. The proposed alternative construction |
| 22 | and funding standards for the school district shall be based on |
| 23 | a 20-year projection plan recommended by an educational |
| 24 | facilities task force that is convened by the school district |
| 25 | and consists of local elected municipal officials and the county |
| 26 | commissioners. The proposed alternative construction and funding |
| 27 | standards shall be published in one newspaper of general |
| 28 | circulation in the school district at least 30 days prior to the |
| 29 | referendum. Exemption from educational facilities construction |
| 30 | and funding standards shall not include exemption from any |
| 31 | educational facilities environmental or safety standards. |
| 32 | Section 2. This act shall take effect July 1, 2004. |
