| 1 | A bill to be entitled | ||
| 2 | An act relating to prevention and control of communicable | ||
| 3 | diseases; amending s. 381.003, F.S.; requiring the | ||
| 4 | Department of Health to adopt certain standards applicable | ||
| 5 | to all public sector employers; requiring the compilation | ||
| 6 | and maintenance of certain information by the department | ||
| 7 | for use by employers; providing an effective date. | ||

| 9 | Be It Enacted by the Legislature of the State of Florida: | ||
| 10 | |||
| 11 | Section 1. Subsection (3) is added to section 381.003, | ||
| 12 | Florida Statutes, to read: | ||
| 13 | 381.003 Communicable disease and AIDS prevention and | ||
| 14 | control.-- | ||
| 15 | (3) The department shall by rule adopt the blood-borne- | ||
| 16 | pathogen standard set forth in subpart Z of 29 C.F.R. part 1910, | ||
| 17 | as amended by Pub. L. No. 106-430, which shall apply to all | ||
| 18 | public sector employers. The department shall compile and | ||
| 19 | maintain a list of existing needleless systems and sharps with | ||
| 20 | engineered sharps-injury protection which shall be available to | ||
| 21 | assist employers, including the department and the Department of | ||
| 22 | Corrections, in complying with the applicable requirements of | ||
| 23 | the blood-borne-pathogen standard. The list may be developed | ||
| 24 | from existing sources of information, including, without | ||
| 25 | limitation, the United States Food and Drug Administration, the | ||
| 26 | Centers for Disease Control and Prevention, the Occupational | ||
| 27 | Safety and Health Administration, and the United States | ||
| 28 | Department of Veterans Affairs. | ||
| 29 | Section 2. This act shall take effect July 1, 2004. | ||
