2An act relating to display of flags in educational
3institutions; providing a popular name; amending s.
41000.06, F.S.; requiring the flag of the United States to
5be displayed in each classroom in public K-20 educational
6institutions; providing for procurement of flags;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  This act shall be known by the popular name the
12"Carey Baker Freedom Flag Act."
13     Section 2.  Section 1000.06, Florida Statutes, is amended
14to read:
15     1000.06  Display of flags.--
16     (1)  Every public K-20 educational institution that is
17provided or authorized by the Constitution and laws of Florida
18shall display daily the flag of the United States and the
19official flag of Florida when the weather permits upon one
20building or on a suitable flagstaff upon the grounds of each
21public postsecondary educational institution and upon every
22district school board building or grounds except when the
23institution or school is closed for vacation, provided that, if
24two or more buildings are located on the same or on adjacent
25sites, one flag may be displayed for the entire group of
26buildings.
27     (2)  Each public K-20 educational institution that is
28provided or authorized by the Constitution and laws of Florida
29shall display daily in each classroom the flag of the United
30States. The flag must be at least 2 feet by 3 feet and must be
31properly displayed in accordance with Title 4 U.S.C. Each
32educational institution shall acquire the necessary number of
33flags to implement the provisions of this subsection. The
34principal, director, or president of each educational
35institution shall attempt to acquire the flags through donations
36or fundraising for 1 year prior to securing other funding
37sources or allocating funds for the purchase of flags. The
38president of each state university or community college must
39present to the governing board of the institution the results of
40donations and fundraising activities relating to the acquisition
41of flags prior to requesting the governing board to approve a
42funding source for the purchase of flags. A flag must be
43displayed in each classroom pursuant to this subsection no later
44than August 1, 2005.
45     Section 3.  This act shall take effect July 1, 2004.
