| 4 | Remove line(s) 8-13, and insert: |
| 5 | Section 2. (1) Notwithstanding the provisions of this |
| 6 | act, any provision of the Internal Revenue Code of 1986, as |
| 7 | amended, which took effect on or before January 1, 2004, |
| 8 | pursuant to the Job and Growth Tax Relief Reconciliation Act of |
| 9 | 2003, shall not be included within the meaning of the term |
| 10 | "Internal Revenue Code," as defined in s. 220.03(1)(n), Florida |
| 11 | Statutes. |
| 12 | (2) The Department of Revenue shall adopt rules to |
| 13 | implement the provisions of this section. |
| 14 | Section 3. The sum of $124,800,000, available as a result |
| 15 | of nonpapplication of the provisions of the Job and Growth Tax |
| 16 | Relief Reconciliation Act of 2003 under the Florida Income Tax |
| 17 | Code pursuant to section 2, is appropriated from the General |
| 18 | Revenue Fund as follows: $55.8 million to the Agency for Health |
| 19 | Care Administration to fund projected growth in the KidCare |
| 20 | program for fiscal year 2004-2005; $10 million to provide for |
| 21 | eligibility under the KidCare program to legal immigrants and |
| 22 | children of state employees; $31 million to avoid an increase in |
| 23 | tuition at community colleges; $21 million to avoid increases in |
| 24 | in-state tuition at state universities; and $6.5 million to |
| 25 | restore the state portion of Medicaid coverage for adult hearing |
| 26 | and vision; and $500,000 in additional funding for the FarmShare |
| 27 | program. |
