1 A bill to be entitled
2          An act relating to driving privilege; providing a popular
3    name; creating s. 318.1225, F.S.; providing additional
4    charges for certain traffic violations; providing for
5    distribution of moneys collected; amending s. 318.21,
6    F.S.; revising provisions relating to disposition of civil
7    penalties by county courts; creating s. 322.287, F.S.;
8    providing additional fees for reinstatement of suspended
9    driving privilege; providing for distribution of moneys
10    collected; providing an effective date.

12          Be It Enacted by the Legislature of the State of Florida:
13         
14          Section 1. This act shall be known by the popular name the
15    "Dori Slosberg Road Safety Act."
16          Section 2. Section 318.1225, Florida Statutes, is created
17    to read:
18          318.1225 Additional charges for violation.--
19          (1) Notwithstanding s. 318.121 and in addition to the
20    stated fines in s. 318.18, the court shall impose an additional
21    $50 fine for all moving violations and an additional $20 fine
22    for all nonmoving violations.
23          (2) Notwithstanding s. 318.121 and in addition to any
24    other fines imposed, the court shall impose an additional $500
25    fine for any person who violates s. 316.027(1).
26          (3) Notwithstanding s. 318.121 and in addition to any
27    other fines imposed, the court shall impose a $500 surcharge on
28    any fine imposed pursuant to s. 316.192, s. 316.193, or s.
29    316.1935.
30          (4) All additional fines and surcharges collected pursuant
31    to this section and s. 322.287 shall be distributed by the
32    department as follows:
33          (a) One million dollars shall be distributed annually to
34    MADD Florida for public service announcements in the state.
35          (b) Ten million dollars shall be distributed annually to
36    the Johnnie Bryars Byrd, Sr., Trust Fund for Alzheimer's
37    Research.
38          (c) Five hundred thousand dollars shall be distributed
39    annually to the Brain and Spinal Cord Injury Program Trust Fund
40    for the purposes set forth in s. 381.79.
41          (d) Five hundred thousand dollars shall be distributed
42    annually to the University of Florida Neuroscience Laboratory.
43         
44          Of the remaining funds resulting from the additional fines and
45    surcharges, 50 percent shall be used to fund new teachers'
46    salaries to meet constitutional school class size requirements
47    and 50 percent shall be used to fund additional highway patrol
48    officers for the enforcement of state traffic laws.
49          Section 3. Subsection (13) is added to section 318.21,
50    Florida Statutes, to read:
51          318.21 Disposition of civil penalties by county
52    courts.--All civil penalties received by a county court pursuant
53    to the provisions of this chapter shall be distributed and paid
54    monthly as follows:
55          (13) The additional fines and surcharges provided for
56    under s. 318.1225 must be collected by the clerk of the court
57    and remitted to the department for distribution as provided in
58    that section.
59          Section 4. Section 322.287, Florida Statutes, is created
60    to read:
61          322.287 Reinstatement fees.--
62          (1) In addition to any other fines, fees, or charges
63    imposed, the department shall impose an additional $50 fee for
64    reinstating and returning a license suspended pursuant to s.
65    322.27.
66          (2) In addition to any other fines, fees, or charges
67    imposed, the department shall impose an additional $500 fee for
68    reinstating and returning a license suspended pursuant to s.
69    322.2615 or s. 322.2616.
70          (3) No driving privileges shall be reinstated until
71    complete payment of the applicable fees under this section.
72          (4) All moneys collected pursuant to this section shall be
73    distributed in the manner provided in s. 318.1225.
74          Section 5. This act shall take effect October 1, 2004.
