| 10 | or grade 12 and for students who have exhausted all |
| 11 | attempts to pass the grade 10 FCAT; deleting obsolete |
| 12 | language; providing an effective date. |

| 14 | Be It Enacted by the Legislature of the State of Florida: |
| 15 |

| 16 | Section 1. Subsection (9) of section 1008.22, Florida |
| 17 | Statutes, is amended to read: |
| 18 | 1008.22 Student assessment program for public schools.-- |
| 19 | (9) EQUIVALENCIES FOR STANDARDIZED TESTS.--Any student who |
| 20 | enters a Florida public school at the eleventh grade or the |
| 21 | twelfth grade or any student who has exhausted all of his or her |
| 22 | attempts to pass the grade 10 FCAT and The Commissioner of |
| 23 | Education shall determine the comparable validity of other |
| 24 | available standardized tests, including the SAT, ACT, College |
| 25 | Placement Test, PSAT, PLAN, and tests used for entry into the |
| 26 | military. If such tests are deemed to be valid and reliable |
| 27 | measures, the commissioner shall approve the use of such tests |
| 28 | as alternate assessments to the grade 10 FCAT for the 2002-2003 |
| 29 | school year. Students who attains attain scores on the SAT or |
| 30 | the ACT that are concordant with equate to the passing scores on |
| 31 | the grade 10 FCAT for purposes of high school graduation on any |
| 32 | of the approved alternative assessments shall satisfy the |
| 33 | assessment requirement for a standard high school diploma as |
| 34 | provided in s. 1003.429(5)(a) or s. 1003.43(5)(a) for the 2002- |
| 35 | 2003 school year graduating class. Prior to the application of |
| 36 | these alternative assessments in subsequent school years, the |
| 37 | Legislature shall review the continued use of these alternative |
| 38 | tests. |
| 39 | Section 2. This act shall take effect upon becoming a law. |
