A bill to be entitled
2An act relating to the Department of Elderly Affairs;
3amending s. 430.071, F.S.; revising the definition of
4"stipend" applicable to respite care volunteers; amending
5ss. 430.204 and 430.205, F.S.; requiring the department to
6fund certain community care and core services for the
7elderly; amending s. 430.502, F.S.; establishing a memory
8disorder clinic at a specified location; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Paragraph (c) of subsection (1) of section
14430.071, Florida Statutes, is amended to read:
15     430.071  Respite for elders living in everyday families.--
16     (1)  As used in this section, the term:
17     (c)  "Stipend" means an allotment of funds to enable a
18diverse population of volunteers to provide services. The
19allotment of funds is for a maximum hourly rate that shall not
20exceed an amount equal to the federal minimum wage period of
21service and is not an hourly wage.
22     Section 2.  Paragraph (b) of subsection (1) of section
23430.204, Florida Statutes, is amended to read:
24     430.204  Community-care-for-the-elderly core services;
25departmental powers and duties.--
26     (1)
27     (b)  For fiscal year 2003-2004 only, The department shall
28fund, through each area agency on aging in each county as
29defined in s. 125.011(1), more than one community care service
30system the primary purpose of which is the prevention of
31unnecessary institutionalization of functionally impaired
32elderly persons through the provision of community-based core
33services. This paragraph expires July 1, 2004.
34     Section 3.  Paragraph (b) of subsection (1) of section
35430.205, Florida Statutes, is amended to read:
36     430.205  Community care service system.--
37     (1)
38     (b)  For fiscal year 2003-2004 only, The department shall
39fund, through the area agency on aging in each county as defined
40in s. 125.011(1), more than one community care service system
41that provides case management and other in-home and community
42services as needed to help elderly persons maintain independence
43and prevent or delay more costly institutional care. This
44paragraph expires July 1, 2004.
45     Section 4.  Paragraphs (j) and (k) of subsection (1) of
46section 430.502, Florida Statutes, are amended, and paragraph
47(l) is added to said subsection, to read:
48     430.502  Alzheimer's disease; memory disorder clinics and
49day care and respite care programs.--
50     (1)  There is established:
51     (j)  A memory disorder clinic at Lee Memorial Hospital
52created by chapter 63-1552, Laws of Florida, as amended; and
53     (k)  A memory disorder clinic at Sarasota Memorial Hospital
54in Sarasota County; and,
55     (l)  A memory disorder clinic at Morton Plant Hospital in
56Pinellas County

58for the purpose of conducting research and training in a
59diagnostic and therapeutic setting for persons suffering from
60Alzheimer's disease and related memory disorders. However,
61memory disorder clinics funded as of June 30, 1995, shall not
62receive decreased funding due solely to subsequent additions of
63memory disorder clinics in this subsection.
64     Section 5.  This act shall take effect July 1, 2004.
