| 5 | Section 7. Paragraph (h) of subsection (1) and paragraph |
| 6 | (a) of subsection (4) of section 1011.62, Florida Statutes, are |
| 7 | amended to read: |
| 8 | 1011.62 Funds for operation of schools.--If the annual |
| 9 | allocation from the Florida Education Finance Program to each |
| 10 | district for operation of schools is not determined in the |
| 11 | annual appropriations act or the substantive bill implementing |
| 12 | the annual appropriations act, it shall be determined as |
| 13 | follows: |
| 14 | (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR |
| 15 | OPERATION.--The following procedure shall be followed in |
| 16 | determining the annual allocation to each district for |
| 17 | operation: |
| 18 | (h) Small, isolated high schools.--Districts which levy |
| 19 | the maximum nonvoted discretionary millage, exclusive of millage |
| 20 | for capital outlay purposes levied pursuant to s. 1011.71(2), |
| 21 | may calculate full-time equivalent students for small, isolated |
| 22 | high schools by multiplying the number of unweighted full-time |
| 23 | equivalent students times 2.75; provided the school attained a |
| 24 | state accountability performance grade of "C" or better for the |
| 25 | previous school year percentage of students at such school |
| 26 | passing both parts of the high school competency test, as |
| 27 | defined by law and rule, has been equal to or higher than such |
| 28 | percentage for the state or district, whichever is greater. For |
| 29 | the purpose of this section, the term "small, isolated high |
| 30 | school" means any high school which is located no less than 28 |
| 31 | miles by the shortest route from another high school; which has |
| 32 | been serving students primarily in basic studies provided by |
| 33 | sub-subparagraphs (c)1.b. and c. and may include subparagraph |
| 34 | (c)4.; and which has a membership of no more than 100 students, |
| 35 | but no fewer than 28 students, in grades 9 through 12. |
| 36 | (4) COMPUTATION OF DISTRICT REQUIRED LOCAL EFFORT.--The |
| 37 | Legislature shall prescribe the aggregate required local effort |
| 38 | for all school districts collectively as an item in the General |
| 39 | Appropriations Act for each fiscal year. The amount that each |
| 40 | district shall provide annually toward the cost of the Florida |
| 41 | Education Finance Program for kindergarten through grade 12 |
| 42 | programs shall be calculated as follows: |
| 43 | (a) Estimated taxable value calculations.-- |
| 44 | 1.a. Not later than 2 working days prior to July 19, the |
| 45 | Department of Revenue shall certify to the Commissioner of |
| 46 | Education its most recent estimate of the taxable value for |
| 47 | school purposes in each school district and the total for all |
| 48 | school districts in the state for the current calendar year |
| 49 | based on the latest available data obtained from the local |
| 50 | property appraisers. Not later than July 19, the Commissioner of |
| 51 | Education shall compute a millage rate, adjusted pursuant to |
| 52 | sub-subparagraph b. and paragraph (c), rounded to the next |
| 53 | highest one one-thousandth of a mill, which, when applied to 95 |
| 54 | percent of the estimated state total taxable value for school |
| 55 | purposes, would generate the prescribed aggregate required local |
| 56 | effort for that year for all districts. The greater of such |
| 57 | millage rate or the prior year's millage rate as calculated |
| 58 | pursuant to this subparagraph and paragraph (c) shall be |
| 59 | certified by the Commissioner of Education shall certify to each |
| 60 | district school board the millage rate, computed as prescribed |
| 61 | in this subparagraph, as the minimum millage rate necessary to |
| 62 | provide the district required local effort for that year. |
| 63 | b. The General Appropriations Act shall direct the |
| 64 | computation of the statewide adjusted aggregate amount for |
| 65 | required local effort for all school districts collectively from |
| 66 | ad valorem taxes to ensure that no school district's revenue |
| 67 | from required local effort millage will produce more than 90 |
| 68 | percent of the district's total Florida Education Finance |
| 69 | Program calculation, and the adjustment of the required local |
| 70 | effort millage rate of each district that produces more than 90 |
| 71 | percent of its total Florida Education Finance Program |
| 72 | entitlement to a level that will produce only 90 percent of its |
| 73 | total Florida Education Finance Program entitlement in the July |
| 74 | calculation. |
| 75 | 2. As revised data are received from property appraisers, |
| 76 | the Department of Revenue shall amend the certification of the |
| 77 | estimate of the taxable value for school purposes. The |
| 78 | Commissioner of Education, in administering the provisions of |
| 79 | subparagraph (9)(a)2., shall use the most recent taxable value |
| 80 | for the appropriate year. |
