| 8 | education; authorizing the Department of Education to |
| 9 | conduct a pilot program within specified counties to |
| 10 | enable selected school districts to realize cost savings |
| 11 | in the purchase of used instructional materials; imposing |
| 12 | requirements on the vendors of such materials; absolving |
| 13 | the state from responsibility for certain financial |
| 14 | losses; requiring the Council for Education Policy |
| 15 | Research and Improvement to report to the Legislature; |
| 16 | providing for future repeal; providing an effective date. |

| 18 | Be It Enacted by the Legislature of the State of Florida: |
| 19 |
|
| 20 | Section 1. Notwithstanding section 1006.37, Florida |
| 21 | Statutes, the Department of Education may conduct a pilot |
| 22 | program to enable selected school districts to realize cost |
| 23 | savings without loss of quality or availability for individual |
| 24 | students in the purchase of used instructional materials. This |
| 25 | program is limited to the counties of Hernando, Pasco, and Polk. |
| 26 | Charter schools in those school districts may also participate |
| 27 | in the pilot program. When a secondhand book dealer or other |
| 28 | third-party book vendor provides used adopted instructional |
| 29 | materials to a school district, the dealer or vendor must |
| 30 | certify the availability of the used instructional materials, |
| 31 | provide the International Standard Book Number of each of the |
| 32 | used instructional materials, and certify that such materials |
| 33 | are not samples or first printings, are the most currently |
| 34 | adopted, Florida-specific instructional materials, and conform |
| 35 | to the Sunshine State Standards. The state is not responsible |
| 36 | for financial loss caused by the school district's deviating |
| 37 | from the requirements of section 1006.37, Florida Statutes. The |
| 38 | Council for Education Policy Research and Improvement shall |
| 39 | submit to the President of the Senate and the Speaker of the |
| 40 | House of Representatives for consideration during the 2005 |
| 41 | Regular Session a report of the cost savings to school districts |
| 42 | based on results of the pilot program. This section is repealed |
| 43 | July 1, 2007. |
| 44 | Section 2. This act shall take effect July 1, 2004. |
