2An act relating to human trafficking; creating s. 787.05,
3F.S.; specifying elements of the offense of unlawfully
4obtaining labor or services; providing criminal penalties;
5creating s. 787.06, F.S.; providing definitions;
6specifying elements of the offense of human trafficking;
7providing criminal penalties; providing applicability;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Section 787.05, Florida Statutes, is created to
13read:
14     787.05  Unlawfully obtaining labor or services.--Any person
15who knowingly obtains the labor or services of a person by:
16     (1)  Causing or threatening to cause bodily injury to that
17person or another person;
18     (2)  Restraining or threatening to restrain that person or
19another person without lawful authority and against her or his
20will; or
21     (3)  Withholding that person's governmental records,
22identifying information, or other personal property,

24commits a felony of the second degree, punishable as provided in
25s. 775.082, s. 775.083, or s. 775.084.
26     Section 2.  Section 787.06, Florida Statutes, is created to
27read:
28     787.06  Human trafficking.--
29     (1)  As used in this section, the term:
30     (a)  "Forced labor or services" means labor or services
31obtained from a person by:
32     1.  Using or threatening to use physical force against that
33person or another person; or
34     2.  Restraining or confining or threatening to restrain or
35confine that person or another person without lawful authority
36and against her or his will.
37     (b)  "Human trafficking" means transporting, soliciting,
38recruiting, harboring, providing, or obtaining another person
39for transport.
40     (2)  Any person who knowingly engages in human trafficking
41with the intent that the trafficked person engage in forced
42labor or services commits a felony of the second degree,
43punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
44     Section 3.  This act shall take effect October 1, 2004, and
45shall apply to offenses committed on or after that date.
