  1                      A bill to be entitled

  2         An act relating to alarm system contracting;

  3         amending s. 633.702, F.S.; providing a criminal

  4         penalty for installing, servicing, testing,

  5         repairing, improving, or inspecting a fire

  6         alarm system without being in compliance with

  7         s. 489.5185, F.S.; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (4) is added to section 633.702,

12  Florida Statutes, to read:

13         633.702  Prohibited acts regarding alarm system

14  contractors or certified unlimited electrical contractors;

15  penalties.--

16         (4)  It is a misdemeanor of the first degree,

17  punishable as provided in s. 775.082 or s. 775.083, for any

18  person to intentionally or willfully install, service, test,

19  repair, improve, or inspect a fire alarm system without being

20  in compliance with s. 489.5185.

21         Section 2.  This act shall take effect October 1, 2004.

23          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
24                         Senate Bill 2088

26  The committee substitute deletes the amendments to s.
    663.702(3)(b), F.S., that provided that it is a first degree
27  misdemeanor to install, service, test, repair, improve, or
    inspect a fire alarm system without being licensed under ch.
28  489 F.S.

29  The committtee substitute adds a new subsection that provides
    that under s. 633.702, F.S., it is a first degree misdemeanor
30  for any person to intentionally or willfully install, service,
    test, repair, improve, or inspect a fire alarm system without
31  being in compliance with the requirements for fire alarm
    system agents provided in s. 489.5185, F.S.
