11  Senator Peaden moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 1, line 17, through
15            page 2, line 9, delete those lines
16  
17  and insert:  
18         Section 1.  Section 472.019, Florida Statutes, is
19  amended to read:
20         472.019  Reactivation; continuing education;
21  reinstatement.--
22         (1)  The continuing education requirements for
23  reactivating a license may not exceed 12 classroom hours for
24  each year the license was inactive.
25         (2)  The board shall adopt promulgate rules relating to
26  licenses which have become inactive and for the renewal of
27  inactive licenses.  The board shall prescribe by rule a fee
28  not to exceed $50 for the reactivation of an inactive license
29  and a fee not to exceed $50 for the renewal of an inactive
30  license.
31         (3)  Notwithstanding the provisions of s. 455.271, the

SENATE AMENDMENT Bill No. CS for SB 2248 Amendment No. ___ Barcode 313202 1 board shall reinstate and the department shall reissue by July 2 1, 2005, the license of an individual whose license has become 3 null, provided all of the following circumstances and 4 qualifications are met: 5 (a) The individual's license was scheduled to be 6 renewed during the biennium period beginning in 2001. 7 (b) The individual did not receive actual timely 8 license renewal notice, as attested to by a signed and 9 notarized affidavit of the individual. 10 (c) The license of the individual was in good standing 11 at the time of the beginning of the renewal cycle. 12 (d) The individual properly petitioned the department 13 for relief relating to the circumstances under which the 14 license became null. 15 (e) The department failed to grant or deny the license 16 renewal petition within 90 days after receiving the petition, 17 as required by the Administrative Procedure Act and s. 18 120.542. 19 (f) No felony or practice act or unlicensed activity 20 penalties have been imposed upon the individual for violations 21 occurring during the period the license was null. 22 23 The individual shall submit an application to the board for 24 reinstatement in a manner prescribed by rules of the board and 25 shall pay the appropriate application fees in an amount equal 26 to the fees imposed for current applicants for new licensure. 27 This subsection expires July 1, 2005. 28 29 30 ================ T I T L E A M E N D M E N T =============== 31 And the title is amended as follows: 2 10:01 AM 04/28/04 s2248c1c-02t5t
