  1                      A bill to be entitled

  2         An act relating to onsite sewage treatment and

  3         disposal systems; amending s. 381.0066, F.S.;

  4         providing for the fees charged by the

  5         Department of Health pertaining to such systems

  6         and in effect on a specified date to remain in

  7         effect until otherwise changed by law;

  8         providing an effective date.

  9  

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Section 381.0066, Florida Statutes, is

13  amended to read:

14         381.0066  Onsite sewage treatment and disposal systems;

15  fees.--

16         (1)  The department may collect fees established by

17  rule pursuant to the schedule in subsection (2) for services

18  provided with respect to onsite sewage treatment and disposal

19  systems. The total fees assessed under this section must be

20  sufficient to meet the cost of administering this section and

21  ss. 381.0065 and 381.00655.

22         (2)  The minimum fees in the following fee schedule

23  shall remain at the amounts in effect on January 1, 2004,

24  apply until changed by general law rule by the department

25  within the following limits:

26         (a)  Application review, permit issuance, or system

27  inspection, including repair of a subsurface, mound, filled,

28  or other alternative system or permitting of an abandoned

29  system:  a fee of not less than $25, or more than $125.

30         (b)  Site evaluation, site reevaluation, evaluation of

31  a system previously in use, or a per annum septage disposal

 1  site evaluation:  a fee of not less than $40, or more than

 2  $115.

 3         (c)  Biennial Operating permit for aerobic treatment

 4  units or performance-based treatment systems: a fee of not

 5  more than $100.

 6         (d)  Annual operating permit for systems located in

 7  areas zoned for industrial manufacturing or equivalent uses or

 8  where the system is expected to receive wastewater which is

 9  not domestic in nature:  a fee of not less than $150, or more

10  than $300.

11         (e)  Innovative technology:  a fee not to exceed

12  $25,000.

13         (f)  Septage disposal service, septage stabilization

14  facility, portable or temporary toilet service, tank

15  manufacturer inspection:  a fee of not less than $25, or more

16  than $200, per year.

17         (g)  Application for variance:  a fee of not less than

18  $150, or more than $300.

19         (h)  Annual operating permit for waterless,

20  incinerating, or organic waste composting toilets:  a fee of

21  not less than $50, or more than $150.

22         (i)  Aerobic treatment unit or performance-based

23  treatment system maintenance entity permit: a fee of not less

24  than $25, or more than $150, per year.

25         (j)  Reinspection fee per visit for site inspection

26  after system construction approval or for noncompliant system

27  installation per site visit: a fee of not less than $25, or

28  more than $100.

29         (k)  Research: An additional $5 fee shall be added to

30  each new system construction permit issued during fiscal years

31  1996-2004 to be used for onsite sewage treatment and disposal

 1  system research, demonstration, and training projects. Five

 2  dollars from any repair permit fee collected under this

 3  section shall be used for funding the hands-on training

 4  centers described in s. 381.0065(3)(j).

 5         (l)  Annual operating permit, including annual

 6  inspection and any required sampling and laboratory analysis

 7  of effluent, for an engineer-designed performance-based

 8  system:  a fee of not less than $150, or more than $300.

 9  

10  The funds collected pursuant to this subsection must be

11  deposited in a trust fund administered by the department, to

12  be used for the purposes stated in this section and ss.

13  381.0065 and 381.00655.

14         Section 2.  This act shall take effect July 1, 2004.
