  1                      A bill to be entitled

  2         An act relating to alcoholic beverage

  3         deliveries; amending s. 561.57, F.S.; exempting

  4         common carriers making certain deliveries from

  5         certain report-filing requirements; requiring

  6         common carriers to verify the age of certain

  7         recipients; providing for defense under certain

  8         circumstances; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (6) of section 561.57, Florida

13  Statutes, is amended to read:

14         561.57  Deliveries by licensees.--

15         (6)  Common carriers are not required to have vehicle

16  permits to transport alcoholic beverages. Nothing in this

17  section shall prohibit any common carrier, or any licensee or

18  other person utilizing a common carrier as his or her agent,

19  from making a delivery from any place within the state to any

20  other place within the state. Intrastate deliveries of

21  alcoholic beverages by common carriers, or licensees or other

22  persons utilizing common carriers as their agents, are exempt

23  from the report filing requirements in s. 562.20. All common

24  carriers acting as designated agents for delivery shall verify

25  that any person receiving alcoholic beverages is at least 21

26  years of age upon the delivery of such alcoholic beverages, as

27  prescribed in the division's rules. The prescribed age

28  verification shall give the common carrier and the licensee or

29  other person hiring the common carrier a complete defense of

30  selling, giving, or serving alcoholic beverages to any person

31  under the age of 21.

 2  law.
