3     Amendment (with title amendment)
4     Remove line(s) 154-172 and insert:
5     d.  The applicant must certify can demonstrate that in the
612 months prior to submission of its application for the
7exemption it transferred is referring 300 or more patients per
8year from the hospital, including the emergency room, for open
9heart surgery or percutaneous coronary intervention cardiac
10services at a hospital with cardiac services, or that the
11average wait for transfer from the transferring hospital for 50
12percent or more of the cardiac patients exceeds 4 hours.
13     e.  The applicant is a general acute care hospital that is
14in operation for 3 years or more.
15     f.  The applicant is performing more than 300 diagnostic
16cardiac catheterization procedures per year, combined inpatient
17and outpatient.
18     g.  The applicant's payor mix at a minimum reflects the
19community average for Medicaid, charity care, and self-pay
20patients for all hospitals in the health service planning
21district and or the applicant must certify that it will provide
22a minimum of 10 5 percent of Medicaid, charity care, and self-
23pay to open-heart-surgery patients. If the applicant fails to
24provide a minimum of 10 percent of Medicaid, charity care, and
25self-pay to open heart surgery patients during each calendar
26year, the applicant's exemption shall be revoked.
27     h.  If the applicant fails to meet the established criteria
28for open-heart programs or fails to reach 300 surgeries per year
29by the end of its third year of operation, the exemption shall
30it must show cause why its exemption should not be revoked.
