                | 8 |  | 
              
                | 9 | Be It Enacted by the Legislature of the State of Florida: | 
              
                | 10 |  | 
              
                | 11 | Section 1.  Section 401.2915, Florida Statutes, is amended | 
              
                | 12 | to read: | 
              
                | 13 | 401.2915  Automated external defibrillators.--It is the | 
              
                | 14 | intent of the Legislature that an automated external | 
              
                | 15 | defibrillator may be used by any person for the purpose of | 
              
                | 16 | saving the life of another person in cardiac arrest. In order to | 
              
                | 17 | achieve that goal, the Legislature intends to encourage training | 
              
                | 18 | in lifesaving first aid, set standards for the use of automated | 
              
                | 19 | external defibrillators, and encourage their use. | 
              
                | 20 | (1)  As used in this section, the term: | 
              
                | 21 | (a)  "Automated external defibrillator" means a lifesaving | 
              
                | 22 | device that: | 
              
                | 23 | 1.  Is approved for premarket modification by the United | 
              
                | 24 | States Food and Drug Administration pursuant to 21 U.S.C. s. | 
              
                | 25 | 360(k); | 
              
                | 26 | 2.  Is capable of recognizing the presence or absence of | 
              
                | 27 | ventricular fibrillation or rapid ventricular tachycardia and is | 
              
                | 28 | capable of determining, without intervention by an operator, if | 
              
                | 29 | defibrillation should be performed; and | 
              
                | 30 | 3.  Automatically charges and delivers an electrical | 
              
                | 31 | impulse to a person's heart when it determines that | 
              
                | 32 | defibrillation should be performed. | 
              
                | 33 | (b)  "Defibrillation" means the administration of a | 
              
                | 34 | controlled electrical charge to the heart to restore a viable | 
              
                | 35 | cardiac rhythm. | 
              
                | 36 | (2)In order to ensure public health and safety: | 
              
                | 37 | (a) (1)All persons who use an automated external | 
              
                | 38 | defibrillator must obtain appropriate training, to include | 
              
                | 39 | completion of a course in cardiopulmonary resuscitation or | 
              
                | 40 | successful completion of a basic first aid course that includes | 
              
                | 41 | cardiopulmonary resuscitation training, and demonstrated | 
              
                | 42 | proficiency in the use of an automated external defibrillator; | 
              
                | 43 | (b) (2)Any person or entity in possession of an automated | 
              
                | 44 | external defibrillator is encouraged to register with the local | 
              
                | 45 | emergency medical services medical director the existence and | 
              
                | 46 | location of the automated external defibrillator; and | 
              
                | 47 | (c) (3)Any person who uses an automated external | 
              
                | 48 | defibrillator shall is required toactivate the emergency | 
              
                | 49 | medical services system as soon as possible upon use of the | 
              
                | 50 | automated external defibrillator. | 
              
                | 51 | Section 2.  This act shall take effect upon becoming a law. |
