1 A bill to be entitled
2          An act relating to additional court costs in cases of
3    certain crimes against minors; creating s. 938.10, F.S.;
4    imposing an additional court cost against persons who
5    plead guilty or nolo contendere to, or who are found
6    guilty of, certain crimes against minors; requiring the
7    clerk of the court to deposit the proceeds of the court
8    cost into the State Treasury for deposit into a specified
9    trust fund to be used to fund child advocacy centers;
10    requiring the clerk of the court to retain a portion of
11    the court cost as a service charge; requiring annual
12    reports; requiring a report to the Legislature; providing
13    applicability; providing an effective date.

15          Be It Enacted by the Legislature of the State of Florida:
16         
17          Section 1. Section 938.10, Florida Statutes, is created to
18    read:
19          938.10 Additional court cost imposed in cases of certain
20    crimes against minors.--
21          (1) If a person pleads guilty or nolo contendere to, or is
22    found guilty of, regardless of adjudication, any offense against
23    a minor in violation of s. 784.085, chapter 787, chapter 794, s.
24    796.03, s. 800.04, chapter 827, s. 847.0145, or s. 985.4045, the
25    court shall impose a court cost of $101 against the offender in
26    addition to any other cost or penalty required by law.
27          (2) Each month, the clerk of the court shall transfer the
28    proceeds of the court cost, less $1 from each sum collected
29    which the clerk shall retain as a service charge, to the State
30    Treasury for deposit into the Child Advocacy Trust Fund for
31    disbursement to the Florida Network of Children's Advocacy
32    Centers, Inc., for the purpose of funding child advocacy centers
33    that are members of the network.
34          (3) At the end of each fiscal year, each child advocacy
35    center receiving revenue from the Child Advocacy Trust Fund must
36    provide a report to the Board of Directors of the Florida
37    Network of Children's Advocacy Centers, Inc., that reflects
38    center expenditures, all sources of revenue received, and
39    outputs that have been standardized and agreed upon by network
40    members and the board of directors, such as the number of
41    clients served, client demographic information, and the number
42    and types of services provided. The Florida Network of
43    Children's Advocacy Centers, Inc., must compile reports from the
44    centers and provide a report to the President of the Senate and
45    the Speaker of the House of Representatives in August of each
46    year beginning in 2005.
47          Section 2. This act shall take effect July 1, 2004, and
48    shall apply to offenses committed on or after that date.
