A bill to be entitled
6An act relating to additional court costs in cases of
7certain crimes against minors; creating s. 938.10, F.S.;
8imposing an additional court cost against persons who
9plead guilty or nolo contendere to, or who are found
10guilty of, certain crimes against minors; requiring the
11clerk of the court to deposit the proceeds of the court
12cost into the State Treasury for deposit into a specified
13trust fund to be used to fund child advocacy centers;
14requiring the clerk of the court to retain a portion of
15the court cost as a service charge; requiring annual
16reports; requiring a report to the Legislature; amending
17s. 39.3035, F.S.; requiring compliance with specified
18provisions in order for a child advocacy center to receive
19certain funding; requiring the Florida Network of
20Children's Advocacy Centers, Inc., to document such
21compliance; providing applicability; providing an
22effective date.

24Be It Enacted by the Legislature of the State of Florida:
25
26     Section 1.  Section 938.10, Florida Statutes, is created to
27read:
28     938.10  Additional court cost imposed in cases of certain
29crimes against minors.--
30     (1)  If a person pleads guilty or nolo contendere to, or is
31found guilty of, regardless of adjudication, any offense against
32a minor in violation of s. 784.085, chapter 787, chapter 794, s.
33796.03, s. 800.04, chapter 827, s. 847.0145, or s. 985.4045, the
34court shall impose a court cost of $101 against the offender in
35addition to any other cost or penalty required by law.
36     (2)  Each month, the clerk of the court shall transfer the
37proceeds of the court cost, less $1 from each sum collected
38which the clerk shall retain as a service charge, to the State
39Treasury for deposit into the Child Advocacy Trust Fund for
40disbursement to the Florida Network of Children's Advocacy
41Centers, Inc., for the purpose of funding child advocacy centers
42that are members of the network.
43     (3)  At the end of each fiscal year, each child advocacy
44center receiving revenue from the Child Advocacy Trust Fund must
45provide a report to the Board of Directors of the Florida
46Network of Children's Advocacy Centers, Inc., that reflects
47center expenditures, all sources of revenue received, and
48outputs that have been standardized and agreed upon by network
49members and the board of directors, such as the number of
50clients served, client demographic information, and the number
51and types of services provided. The Florida Network of
52Children's Advocacy Centers, Inc., must compile reports from the
53centers and provide a report to the President of the Senate and
54the Speaker of the House of Representatives in August of each
55year beginning in 2005.
56     Section 2.  Subsection (3) of section 39.3035, Florida
57Statutes, is amended to read:
58     39.3035  Child advocacy centers; standards; state
59funding.--
60     (3)  A child advocacy center within this state may not
61receive the funds generated pursuant to s. 938.10, state or
62federal funds administered by a state agency, or any other funds
63appropriated by the Legislature unless all of the standards of
64subsection (1) are met and the screening requirement of
65subsection (2) is met. The Florida Network of Children's
66Advocacy Centers, Inc., shall be responsible for tracking and
67documenting compliance with subsections (1) and (2) for any of
68the above funds it administers to its member child advocacy
69centers Any child advocacy center within this state that meets
70the standards of subsection (1) and is certified by the Florida
71Network of Children's Advocacy Centers, Inc., as being a full
72member in the organization shall be eligible to receive state
73funds that are appropriated by the Legislature.
74     Section 3.  This act shall take effect July 1, 2004, and
75shall apply to offenses committed on or after that date.
