  2         An act relating to trust funds; creating s.

  3         370.1203, F.S.; creating the Manatee Population

  4         Study Trust Fund within the Fish and Wildlife

  5         Conservation Commission; providing for the use

  6         of funds and the source of funds; providing for

  7         review and termination or re-creation of the

  8         trust fund; providing a contingent effective

  9         date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 370.1203, Florida Statutes, is

14  created to read:

15         370.1203  Manatee Population Study Trust Fund.--

16         (1)  The Manatee Population Study Trust Fund is created

17  within the Fish and Wildlife Conservation Commission for the

18  purpose of providing funds for scientific studies of the

19  manatee or sea cow (Trichechus manatus). Trust fund moneys

20  shall be used exclusively for the purpose of conducting

21  population, marine habitat, food source, and other scientific

22  studies of the manatee. Funds credited to the trust funds

23  consist of those funds annually appropriated from the Marine

24  Fuel Tax and the Save the Manatee Trust Fund.

25         (2)  In accordance with Section 19(f)(2) of Article III

26  of the State Constitution, the trust fund shall be terminated

27  on July 1, 2008, unless terminated sooner. Before its

28  scheduled termination, the trust fund shall be reviewed as

29  provided in section 215.3206(1) and (2), Florida Statutes.

30         Section 2.  This act shall take effect July 1, 2004, if

31  SB ____ or similar legislation requiring a manatee population

 1  study is adopted in the same legislative session, or an

 2  extension thereof, and becomes law.
