18         Section 10.  Subsections (1), (9), and (11) of section
19  400.9935, Florida Statutes, are amended to read:
20         400.9935  Clinic responsibilities.--
21         (1)  Each clinic shall appoint a medical director or
22  clinic director who shall agree in writing to accept legal
23  responsibility for the following activities on behalf of the
24  clinic. The medical director or the clinic director shall:
25         (a)  Have signs identifying the medical director or
26  clinic director posted in a conspicuous location within the
27  clinic readily visible to all patients.
28         (b)  Ensure that all practitioners providing health
29  care services or supplies to patients maintain a current
30  active and unencumbered Florida license.
31         (c)  Review any patient referral contracts or

SENATE AMENDMENT Bill No. CS for SB 560 Amendment No. ___ Barcode 823884 1 agreements executed by the clinic. 2 (d) Ensure that all health care practitioners at the 3 clinic have active appropriate certification or licensure for 4 the level of care being provided. 5 (e) Serve as the clinic records owner as defined in s. 6 456.057. 7 (f) Ensure compliance with the recordkeeping, office 8 surgery, and adverse incident reporting requirements of 9 chapter 456, the respective practice acts, and rules adopted 10 under this part and part II of chapter 408. 11 (g) Conduct systematic reviews of clinic billings to 12 ensure that the billings are not fraudulent or unlawful. Upon 13 discovery of an unlawful charge, the medical director or 14 clinic director shall take immediate corrective action. If the 15 clinic performs only the technical component of magnetic 16 resonance imaging, static radiographs, computed tomography, or 17 position emission tomography, and provides the professional 18 interpretation of such services, in a fixed facility that is 19 accredited by the Joint Commission on Accreditation of 20 Healthcare Organizations or the Accreditation Association for 21 Ambulatory Health Care, and the American College of Radiology; 22 and if, in the preceding quarter, the percentage of scans 23 performed by that clinic which was billed to all personal 24 injury protection insurance carriers was less than 15 percent, 25 the chief financial officer of the clinic may, in a written 26 acknowledgement provided to the agency, assume the 27 responsibility for the conduct of the systematic reviews of 28 clinic billings to ensure that the billings are not fraudulent 29 or unlawful. 30 31 (Redesignate subsequent sections.) 2 4:02 PM 04/26/04 s0560c1c-3720c
