1 A bill to be entitled
2          An act relating to multiservice senior centers; amending
3    s. 430.203, F.S.; amending a definition; amending s.
4    403.206, F.S.; encouraging each multiservice senior center
5    to have a functioning automated external defibrillator;
6    requiring training, maintenance, and location
7    registration; providing immunity from liability under the
8    Good Samaritan Act and the Cardiac Arrest Survival Act;
9    authorizing the Department of Eldery Affairs to adopt
10    rules; requiring the department to arrange for purchase of
11    such defibrillators; requiring certain entities to
12    reimburse the department for purchased defibrillators
13    under certain circumstances; providing criteria for
14    distribution of such defibrillators; providing an
15    appropriation; providing effective dates.

17          Be It Enacted by the Legislature of the State of Florida:
18         
19          Section 1. Subsection (10) of section 430.203, Florida
20    Statutes, is amended to read:
21          430.203 Community care for the elderly; definitions.--As
22    used in ss. 430.201-430.207, the term:
23          (10) "Multiservice senior center" means a community
24    facility for the organization and provision of a broad spectrum
25    of that serves as the focal point for housing and delivering
26    services, which shall include provision of health, including
27    mental health, social, nutritional, and education services, and
28    the provision of facilities for recreational activities for to
29    persons 60 years of age or older. A multiservice senior center
30    may also be a facility as designated by the department in its
31    master plan prepared pursuant to s. 430.04(3).
32          Section 2. Subsection (3) is added to section 430.206,
33    Florida Statutes, to read:
34          430.206 Multiservice senior center.--
35          (3)(a) Effective July 1, 2005, each multiservice senior
36    center is encouraged to have on the premises at all times a
37    functioning automated external defibrillator.
38          (b) Multiservice senior centers that provide automated
39    external defibrillators shall ensure that personnel are properly
40    trained in accordance with s. 401.2915.
41          (c) The location of each automated defibrillator shall be
42    registered with the appropriate county office by the
43    multiservice senior center pursuant to s. 401.2915.
44          (d) The use of automated external defibrillators by
45    employees and volunteers shall be covered under the provisions
46    of ss. 768.13 and 768.1325.
47          (e) The department may adopt rules to implement the
48    provisions of this section.
49          Section 3. There is hereby appropriated to the Department
50    of Elderly Affairs a sum of $270,000 to implement the provisions
51    of this act. The department shall arrange for the purchase of as
52    many automated external defibrillators as may be purchased with
53    available funds. Senior centers shall reimburse the department
54    for 50 percent of the cost of the automated external
55    defibrillator provided to their facility. Multiservice senior
56    centers located in rural communities, as defined in ss.
57    288.0656(2)(b) and 288.06561, Florida Statutes, shall not be
58    required to reimburse the department for the costs of such
59    equipment. The department shall authorize issuance of the
60    equipment to senior centers in the order in which they request
61    one and shall provide authorization for only one to each
62    multiservice center pursuant to this section.
63          Section 4. Except as otherwise provided herein, this act
64    shall take effect upon becoming a law.
