| 1 | A bill to be entitled | ||
| 2 | An act relating to school food service programs; amending | ||
| 3 | s. 1006.06, F.S.; requiring each district school board to | ||
| 4 | ensure that only beverages meeting certain criteria are | ||
| 5 | sold or distributed in schools in the school district; | ||
| 6 | providing an effective date. | ||

| 8 | Be It Enacted by the Legislature of the State of Florida: | ||
| 9 | |||
| 10 | Section 1. Subsection (3) of section 1006.06, Florida | ||
| 11 | Statutes, is amended to read: | ||
| 12 | 1006.06 School food service programs.-- | ||
| 13 | (3)(a)Each district school board shall consider the | ||
| 14 | recommendations of the district school superintendent and adopt | ||
| 15 | policies to provide for an appropriate food and nutrition | ||
| 16 | program for students consistent with federal law and State Board | ||
| 17 | of Education rule. | ||
| 18 | (b) Each district school board shall ensure that only the | ||
| 19 | following beverages are sold or distributed in the school | ||
| 20 | district's elementary, middle, and high schools: | ||
| 21 | 1. Water without additives. | ||
| 22 | 2. Low-fat, reduced-fat, and fat-free milk, including, but | ||
| 23 | not limited to, chocolate milk, strawberry milk, soy milk, | ||
| 24 | nondairy milk, and rice milk. | ||
| 25 | 3. Fruit-based beverages that are composed of no less than | ||
| 26 | 50 percent fruit juice. | ||
| 27 | 4. Beverages with no added sugar content. | ||
| 28 | 5. Noncaffeinated beverages. | ||
| 29 | Section 2. This act shall take effect July 1, 2004. | ||
